UPDATE: With all the new talk about the Menendez brothers it reminds me of this Noval case. Children killed parents to get inheritance early. Kids were also mad that dad may have cut them off. You really have to be evil to do that to a parent.

12/23/2016 I just looked up the court docs on this case. The jury ruled for Lourdes and Tania. I had to pull up the ruling to try to understand what happened. Here is the verdict and the questions given to the jury. How the questions are written is the most important thing in a jury trial. That's how OJ got off.

The main question is number 9, "Did Lourdes Frost or Tania Noval fail to use the degree of care that a reasonable person in the same situation would have used in handling Victorino Noval's health care decisions during his final hospitalization?"

The jury's answer was "no." I don't get this. Medical experts, hospital employees were questioned and spoke. Kaiser employees requested immunity which means they believe they did something wrong and criminal. Victorino was improving. Lourdes and Tania per court documents lied about Victorino's health condition to the doctors, nurses. They also never asked Hector to help decide. I personally believe that if Hector knew he had power over medical decisions, he would not have asked the doctors to basically kill his father. I received all this information from legal documents and other articles written about the case.

My only thought on this is the jury saw an elderly man who was ill. How much time did he have left? Who is to say how long he had left but I believe the experts said years. How much is years of someone's life worth? A hospital put a pace maker in my grandmother. They accidentally tore the valve putting the wire in. We didn't sue because she was basically okay and she was 86. Plus we wouldn't want to put her through a lawsuit when she didn't need or want money anyway. A lawyer friend said due to her age any award would be small. She lived to 90.

I think the questions leaned toward protecting Kaiser. I'm sure Kaiser donates to local Judges, campaigns. The courts will always favor a big business over the little guy due to campaign donations. While Kaiser wasn't a party, a ruling for Lourdes, Tania would help Kaiser. There could still be a criminal case.

A sad day in our justice system. I can't imagine what the Defense counsel showed to the court to sway the jury into not finding enough information that they intentionally gave the order to kill their father who was not dying. I still believe based on all the evidence I saw that Tania, Lourdes gave the doctors order to kill their father so they could receive their inheritance early. Plaintiff's attorneys believed that as well as they took the case on contingency.

I think this case should make it mandatory that all power of attorney forms must be shown in person to the doctors, nurses. All people who have power over medical decisions should make final decisions. If Hector were there, I believe his father would be alive today.

People need to be really careful to make sure the person making their medical conditions will not financially benefit from their death. Maybe we need a law that makes it illegal for someone who could benefit from the death to be able to make these life or death decisions. People also need to be careful about who is taking care of them when they are older. You obviously would not want people such as Victor Noval around you.

"Three siblings, Lourdes Frost (Lourdes), Tania Noval (Tania), and Victor
Noval (Victor), allegedly directed a hospital to take their father, Victorino Noval
(decedent), off life support and administer fatal doses of morphine, without the consent of
their brother, Hector Noval (Hector),1 whose permission was required under a durable
power of attorney for healthcare. Lourdes, Tania, and Victor also allegedly absconded
with cash and other personal property of decedent while he was hospitalized."

Court ultimately ruled "Here, we cannot conclude that Hector failed to allege facts sufficient to state a
viable cause of action."

"FACTS
A. Allegations of Complaint:
 In his complaint, Hector alleged the following:

1 We refer to the parties by their first names for ease of reference. We mean
no disrespect. (In re Marriage of Balcof (2006) 141 Cal.App.4th 1509, 1513, fn. 2.)

 Decedent was a fully functioning 78-year-old with about $60 million in
assets and $3 million in annual income. On April 28, 2010, decedent was admitted to the
hospital with pneumonia. He was intubated and, when sedated, became temporarily
incapable of making his own medical decisions. By the end of the 10-day hospitalization,
decedent had overcome the pneumonia, had had his intubation removed, had become
distress free, and could make “‘eye contact for more than 10 seconds.’” Nonetheless,
Lourdes, Tania, and Victor ordered hospital staff to terminate decedent’s treatment and
administer fatal doses of morphine on May 7, 2010, causing his death that day. The only
reason the threesome so directed hospital staff was to hasten decedent’s death and collect
their inheritances.

 According to Hector, decedent had a durable power of attorney for health
care (health care power) that named Hector and Lourdes as joint attorneys-in-fact, such
that the unanimous consent of the two of them was required for action to be taken.
However, Lourdes, Tania and Victor falsely represented to hospital staff that Hector
concurred in their decision to end decedent’s life, and concealed the existence of the
health care power from Hector himself. Furthermore, at the same time that they directed
hospital staff to withdraw decedent’s treatment and end his life, they misrepresented to
Hector that decedent’s treatment would be continued indefinitely. On May 7, 2010,
Lourdes contacted Hector and told him decedent had died of natural causes. She did not
mention “any withdrawal of treatment, terminal extubation, or fatal injections of
morphine.” So, Hector had no reason to suspect foul play.

 Hector alleged that he did not learn of the existence of the health care
power until February 2011, when it was disclosed during probate proceedings. Health
care power in hand, Hector was then able to obtain a copy of decedent’s hospital medical
records, which disclosed a set of facts entirely different from what he had previously
been told. Apparently, Lourdes had told hospital staff that decedent had advanced

Parkinson’s disease, had been declining over the preceding six months, had a poor quality
of life, would not want to be hooked up to a ventilator, would not want to be resuscitated,
and would want to die peacefully. Lourdes, Tania and Victor met with hospital staff on
May 4 and 5, 2010 and represented that the whole family, Hector included, “desired
terminal extubation for decedent.” (Capitalization omitted.) They also represented to
hospital staff, on May 5 and 6, 2010, that Hector “was a violent person, a drug addict,
someone with paranoid personality,” who had “‘threatened violence’ against them . . .
and that they were ‘afraid’ of him.” Hector further alleged that his siblings had
represented to hospital staff that he had ulterior motives and was unfit to make health
care decisions for decedent.

 Lourdes, Tania and Victor met with hospital staff on May 7, 2010 for “the
planned withdrawal of decedent’s treatment and fatal injections or morphine[.]”
(Capitalization omitted.) Even though they were informed that decedent was improving,
they declined “the opportunity to . . . cancel decedent’s planned death[.]” (Capitalization
omitted.) Moreover, they again falsely informed hospital staff that Hector was in favor of
the plan, and said he simply elected not to be present. To the contrary, Hector was not
even aware of the plan. Hospital staff removed the ventilator, withdrew oxygen support,
removed the nutritional tubes, and administered fatal doses of morphine. According to
Hector, decedent would have lived absent these acts. "

Victorino Noval, 78, entered a Kaiser hospital in Southern California on April 28, 2010, with a diagnosis of aspiration pneumonia. He was intubated, placed on a mechanical ventilator, and sedated. His medical history included early stages of Parkinson’s, and COPD. Noval was totally independent prior to his hospitalization. He lived in his own home, drove his own car, performed his own daily living activities, managed his own finances and investments, and had an annual income of $3 Million. He was worth an estimated $60 Million. He never left the hospital alive and a lawsuit filed by his son in Riverside County, California, alleges some very serious shenanigans. And here are the highlights, according to the complaint which is available in full below:

On May 7th, 2010, despite exhibiting improvement in his pneumonia and having a positive prognosis for recovery, Kaiser staff removed Noval from his ventilator, extubated him, and then administered large doses of morphine with the sole intention being to bring about his death. They succeeded. And this was all done without consulting his son, Hector Noval, despite the fact that Kaiser had an executed durable power of attorney (DPOA) for health care naming Hector and his sister, Lourdes Frost, as co-attorneys in fact. Under California law the hospital would be required to consult with both of them regarding any medical decisions if the elder Noval was incapacitated, and would have to receive unanimous approval in order to gain consent for any changes in treatment. But Frost and their other sister, Tania Noval, apparently conspired to convince hospital staff that their father suffered from dementia, had a very poor quality of life and poor baseline health, and had made it clear he never wanted to be on mechanical ventilation for any period of time. All of this was untrue according to Hector. The motivation of the sisters? To hasten their father’s death in order to collect the inheritance.

On February 2, 2012, Hector Noval filed suit in Riverside County Superior Court naming Kaiser Foundation Hospitals, Dr. Richard Bradburne , social worker  Anthony Tapia, hospital bioethics specialist Dan Wilson, and 50 unnamed “Does”, and alleging, among other things, negligence, wrongful death, fraud, elder abuse, lack of informed consent and medical battery. The details of the events alleged in the complaint are so disturbing that, if true, could give rise to criminal charges of manslaughter against the named defendants. The death of Michael Jackson at the hands of his physician pales in comparison to the death of Noval, which was consciously and purposely planned, and brought about with specific, intentional, overt, targeted actions.

According to the complaint filed with the court by Hector Noval, the following took place: On the very first day of Noval’s admission, his son Hector requested he be transferred to Cedar’s Sinai Hospital. For reason’s unknown, Kaiser refused. On May 3, Frost provided Kaiser with a copy of the DPOA, but Hector was unaware that he was named co-attorney in fact, and was also unaware of his powers and responsibilities in that role. Kaiser at no time informed Hector that they had received the DPOA. that it even existed, or that he was named as attorney in fact. Also on May 3, Frost and her sister met with defendants  Bradburne and Tapia and falsely claimed that Noval had a history of “advanced” Parkinson’s Disease and that he had “declined functionally” over the past “six months,” suffering from “problems with gait and balance.” Despite being aware of the DPOA, the defendants only discussed Noval’s medical history and plan of care with the two sisters, and never approached Hector Noval, even while being aware he had come to the hospital on multiple occasions expressing an interest in being involved in the decisions regarding the care of his father.

On May 3, Dr. Bradburne also prescribed an additional 1-2 weeks of aggressive treatment for the elder Noval. Yet the next day the two sisters met again with Tapia and informed him that the entire family had discussed their father’s situation and agreed that the proper course of action should be “terminal extubation”, meaning the breathing tube should be removed, the ventilator shut off, all treatment withdrawn and Victorino Noval should be allowed to die. They went so far as to ask the social worker to call a Catholic priest to administer the last rights, which Tapia did. He also conveyed the “unanimous” wishes of the family to the other defendants.

The sisters set about convincing the hospital staff that their brother was a drug addict and suffered from mental illness.  Tania Novel had a previous relationship with Tapia  and it is alleged she used this existing familiarity with him to her and her sister’s advantage. He even made notations in the medical record regarding the unfavorable characterization of her brother, which were read by the other treatment providers. On May 5th when Hector came to the hospital to visit his father, Tapia, without explanation, met him at the entrance with a security guard who searched him for weapons. Tapia then took Hector to a conference room and told him that “terminal extubation” was going to take place the following day, also without explanation of why the change in care was taking place. Hector again asked that his father be transferred and also that the extubation be delayed. This would be the ONLY discussion he had with hospital staff about extubation. Hector left the hospital and retained an attorney.

Tapia wrote in the medical record medical file that “the entire family is in agreement with terminal extubation except now [Hector] showed up today and is causing conflict.” Tapia did not stop there: “family discussion, all siblings except one son [Hector] and wife are in agreement [regarding terminal extubation] … the son in disagreement is an habitual drug abuser/addict and his judgments and motives are likely not sound in the context of acting as a surrogate decision maker.” All of this was false and Tapia had no authority to disregard the provisions of the DPOA.

The evening of May 5th Hector, through his attorney, scheduled a meeting with his sisters to discuss their father’s care. When the sisters arrived, they produced a purported Will and a purported Trust. No DPOA. They told Hector and his counsel that the Will and Trust were “the only documents that existed” and acted as if they didn’t know what a DPOA or Healthcare Directive was. They told him to stop complaining about their father’s impending death because he’d inherit millions of dollars. They said, nonetheless, that the father would have wanted him to participate in his end-of-life decisions, and they represented that they would allow him to do so. Hector and his counsel demanded that no terminal extubation take place without his knowledge and consent. He also requested that the father, when able, be taken off sedation to communicate with his family and make his own health care decisions, and that, when reasonable, he be transferred to Cedar Sinai or a like-facility. The sisters agreed to honor these demands. This was Hector’s last conversation with the sisters before the father’s death.

The very next day, May 6th, the sisters met with the defendants and again insisted on the terminal extubation being carried out, mentioning nothing about the discussions and agreement with their brother the night before. Instead,  they claimed that Hector had threatened them with violence and that they were living in fear of him. A nurse documented the alleged threats of violence in the patient’s chart and the hospital’s bioethics expert, Dan Wilson, was consulted regarding how to proceed as to the decision-making in Noval’s medical care. May 6 also saw improvement in Noval’s condition including lungs clearing on X-ray and improved lung function. Bradburne opined that Noval might even be well enough to breathe on his own without the ventilator.

On May 7,  despite Dr. Bradburne  advising the sisters that their father’s condition had further improved even more from the previous day and was not terminal, Noval was extubated at their request, taken off the ventilator and given high doses of morphine to bring about his death. It took approximately 85 minutes of oxygen therapy being removed and high dose morphine being administered, before Noval died. For all intents and purposes according to these allegations he was euthanized. Hector claims he was never informed of any of this before the fact. Bradburne wrote the following note in the chart: “[Frost] confirmed that her brother Hector has agreed to follow family wishes regarding extubation and has decided not to be present at actual event.” Hector arrived at the hospital intending to visit his father only to discover he was dead. Even then, no one told him the death was the result of a “terminal” extubation. The sisters told him their father’s condition had worsened and he had died despite having all possible care.

It was not until February of 2011 that Hector discovered the existence of the DPOA during the processing of his father’s estate. He obtained the medical records thereafter and it became clear what had happened. The sisters are not named in the lawsuit. For their alleged role in events, IF true, a criminal charge of first degree murder would seem to be sustainable. To date there is no indication that this has become a criminal matter however, and remember the information in the lawsuit complaint is always only one side of the story. The answer is always a completely DIFFERENT story so the truth often lies in the middle. Read the entire complaint below:"

The Victorino Noval Story.
Victorino Noval was born in Spain. He later went to Cuba where he became highly successful. During the political turmoil in Cuba he came to the United States and his wife and children later followed. He wanted a better life for himself and his family. He became a very wealthy man due to hard work and good business practices.
He developed pneumonia and was hospitalized. While the ambulance was taking him to the hospital someone went into Mr. Noval's safe. An allegation has been made that there was $400,000 cash in the safe at the Noval home that disappeared that day. One of the daughters states that there was not a single penny in the safe when she opened it. The other sister requested a DNR order for her father upon arrival at the ER at Desert Valley Hospital .
Mr. Noval got better with medical care.
While Kaiser hospital was preparing paperwork for his release to go home as he was recovering, some of his children made arrangements for him to have an untimely death. The Kaiser staff then stopped the release to home and terminally extubated him. This was all done without consulting his son, Hector Noval, despite the fact that Kaiser had an executed durable power of attorney (DPOA) for health care naming Hector and his sister, Lourdes Frost, as co-attorneys in fact. This was done solely on the word of Hector's sister and with what appears to be some life long friends of hers that work at Kaiser and who were involved in Victorino's death. The medical staff was convinced by the sister that Hector Noval was in agreement with this decision and no one bothered to verify if the verbal statement was truthful.
Recently a Deposition of the Trust lawyer was taken. When asked when was it he was made aware of his representation as legal representative for the Victorino Noval Trust his answer was when Lourdes Frost, the sister called him from the Hospital and told him that her father was going to die and that she was Trustee and would need his services . So Victorino Noval was getting treatment and improving but the sister hired a trust lawyer, telling him that her father was going to die .
What the siblings of Hector Noval had done to make matters worse was to attempt to keep Hector Noval away from the hospital through legal means. At the time Hector was not aware that he was duel POA with his sister. That information was not revealed to him until one year after the death of his father. You have to wonder why the siblings went out of their way to not let him know about this. Maybe it was to avoid having any staff at the hospital ask Hector about what he wanted done regarding the care of his father.
Mr. Noval wanted to live and Kaiser records indicate that Mr. Noval was recovering and would be returning home. Hector had no idea that this was taking place. Mr. Noval died within minutes once Kaiser started the extubation from a morphine overdose. The sibling who lied to Kaiser inherited several million dollars.
Lawsuits were filed and the police became involved. The staff at the hospital are pleading the 5th so depositions cannot be taken.

     A son claims a Kaiser hospital ignored his wealthy father's power of attorney so the plaintiff's greedy siblings could collect multimillion-dollar inheritances.

     Hector Noval sued Kaiser Foundation Hospitals and affiliates, a doctor and two social workers on behalf of his father, Victorino Noval, who died in May 2010 after a "terminal extubation." Noval says his father had been involuntarily admitted to Kaiser's intensive care unit for pneumonia on April 28, 2010, while suffering from early-stage of Parkinson's and chronic obstructive pulmonary disease.

     Before being hospitalized, Noval, 78, "lived in his own home, drove his own vehicle, and performed his own activities of daily living," according to the Superior Court complaint. "He was worth $60 million and had annual income of $3 million. He made investments and controlled his finances. He suffered from no neurological deficiencies. He did not have dementia or diminished capacity, He functioned independent of others. He was in no way nearing death, an irreversible coma, or a persistent vegetative state. Upon hospitalization, he only required temporary oxygen support while the pneumonia infection in his lungs cleared and he regained his strength. His condition was no more serious than that."

     However, Hector Noval says, two of his sisters, Lourdes Frost and Tania Noval, told Kaiser doctors, "falsely and fraudulently," that their father had "'advanced' Parkinson's disease" and had been declining for 6 months before his hospitalization.

     He claims that his siblings' false and fraudulent statements included "that he 'would not want to be hooked to a machine like a ventilator,' even if just temporarily, and that 'he had expressed this to [his] daughter both when he is well, and when not so well.' Frost and Noval told defendants that decedent 'would not [have] wanted to be resuscitated if he is to pass away ... he would want to die peacefully if that was to happen.' Each of these statements were untrue. Defendants performed no diligence into their veracity and accepted them as true."

     Neither sister is named as a defendant.

     Plaintiff Noval claims that on the day his father was admitted, April 28, 2010, he "expressed his desire that decedent be transported to Cedar Sinai in Beverly Hills, California for treatment and that he not be treated at Kaiser. Defendants acknowledged these desires but refused to honor them." (Emphasis in complaint.)

     Noval says he has three adult siblings. He says his sisters Lourdes Frost and Tania Noval "desired decedent's death to collect their multimillion-dollar inheritances." He claims that Tania Noval "had a pre-existing relationship with [defendant social worker Anthony] Tapia.

     Hector Noval claims that after his father was "sedated for comfort," Frost filed with Kaiser a copy of their father's durable power of attorney for health care, dating from July 1999. He says the power of attorney named him and Frost as their father's attorney in fact, and that California law required the defendants to get consent from both of them to make health care decisions for their father.

     But he says, "Defendants did not of this. They never disclosed the DPOA [durable power of attorney] to plaintiff or advised him of his rights or responsibilities therein. Neither did Frost or [defendant] Noval. Plaintiff was never made aware of the DPOA or his rights and responsibilities therein."

     In the days that followed, Hector Noval says, his father's doctor, defendant Richard Bradburne, and social worker Tapia met with his sisters and discussed their father's condition, medical outlook and quality of life.

     On May 3, he says, Dr. Bradburne prescribed "1-2 more weeks of continued aggressive treatment for the decedent. Plaintiff was at Kaiser at the time and again requested that defendants transport decedent to Cedar Sinai or a like facility. Defendants refused. They never disclosed the DPOA or discussed it with plaintiff, and plaintiff went unaware of his rights in the matter."

     Hector Noval claims that on May 4 his sisters "met with Tapia and told him that 'the entire family' desired terminal extubation, i.e. the withdrawal of treatment and death. 'The entire family' did not desire terminal extubation. Frost and [Tania] Noval instructed Tapia to contact a Catholic priest to visit [Victorino] Noval and read his last rites. Tapia did so. Tapia then communicated to defendants that the 'family' desired terminal extubation. No one contacted plaintiff or informed him that any of this was taking place. "Plaintiff was unaware of all of this," according to the complaint.

     Hector Noval claims that when he entered the Kaiser hospital on May 5, "Tapia appeared with security at the entrance and had plaintiff searched by security for weapons. No explanation was given. Tapia then took plaintiff to a conference room and told him that decedent was going to be terminally extubated the following day. He gave plaintiff no explanation for the change in treatment and didn't discuss the DPOA with plaintiff or advise plaintiff that he was a 'joint agent' for health care decisions and had the authority to prevent, delay, or postpone it."

     Hector Noval says he asked that terminal extubation be delayed and asked again that he father be sent to Cedars Sinai. The complaint states: "Tapia tried convincing plaintiff otherwise but ultimately agreed to communicate his request to delay extubation and said he would 'continue to follow up' with plaintiff and have 'continued conversations' with him 'regarding treatment and terminal extubation.' This was plaintiff's only conversation with Tapia regarding treatment and extubation. They never spoke again despite Tapia's promise.

     "Plaintiff left and retained counsel.

     "Tapia recorded in decedent's medical file that 'the entire family is in agreement with the terminal extubation except now [plaintiff] showed up today and is causing conflict.' He also recorded that plaintiff 'had history of substance abuse and paranoid personality.' Neither statement was true, and neither was discussed with plaintiff. Tapia wrote them in the record after hearing them from Frost and {Tania} Noval and without performing any diligence or due care into their veracity." (Brackets, but not braces, as in complaint.)

     Noval says Tapia "spread these misstatements to defendants, including Bradburne, who wrote in decedent's medical record: 'family discussion, all siblings except one son [plaintiff] and wife are in agreement [regarding terminal extubation] ... the son in disagreement [plaintiff] is a habitual drug user/addict and his judgments and motives are likely not sound in the context of acting as a surrogate decision maker.'" (Brackets as in complaint.)

     Hector Noval adds: "One single telephone call to plaintiff or related effort would have cleared the matter. Yet no defendant sought to communicate directly with plaintiff. He was unaware these allegations were being made about him."

     The complaint continues: "Bradburne has since apologized for the medical record, stating that Tapia 'had informed me at some point that this information [about plaintiff] had been alleged.' 'That is not a fair statement actually [about plaintiff].' 'I'm making a statement of fact there and that's not true.' 'The keyword that's left out of that sentence is "alleged."' ... He said 'frankly, I regret writing that way.'" (Brackets, but not ellipsis, as in complaint.)

     Hector Noval claims that he called a meeting with the sisters on the evening of May 5. He says his sisters produced a will and a trust, and told him to "stop complaining about decedent's death because he'd inherit millions of dollars."

     At the meeting, Hector Noval says, he and his lawyer demanded that no terminal extubation take place without his knowledge and consent and that when reasonable, their father be taken off sedation so he could communicate his wishes and direct his own care. He claims that both sisters "agreed to honor these demands. This was plaintiff's and counsel's last communication with Frost and/or Noval before decedent's death."

     Hector claims that on May 6, his two sisters met with Kaiser, and said "that plaintiff had 'threatened violence' the evening before and that they were 'afraid' of him. These were false and fraudulent misrepresentations designed solely to discredit and disparage plaintiff and convince defendants to terminally extubate pursuant to their instructions."

     He claims that had any of the defendants "made one single telephone call to plaintiff or related effort, they would have discovered the allegations of violence were untrue, that plaintiff had retained counsel, and that Frost and Noval were committing egregious fraud and fraudulent concealment to accomplish their father's death."

     On May 6, Hector says, the defendants referred this "true conflict" to defendant Dan Wilson, "a 'bioethics director' and/or on the 'bioethics committee' at Kaiser, to perform an analysis into how to handle decedent's health care going forward."

     Hector claims Wilson interviewed his sisters - but not him - "and concluded plaintiff was in a 'clearly impaired condition' and that Kaiser should proceed with terminal extubation at the desires of 'joint agent [Frost] and the remaining family members.'" (Brackets in complaint.)

     Hector says that Wilson never met with him, never communicated with him, and that no one at the hospital ever informed him of Wilson's involvement or conclusions.

     "Plaintiff believed, instead, from his discussion with Tapia on May 5 that Kaiser would communicate with him before terminal extubation, and from his discussion with Frost and [Tania] Noval on the evening of May 5, that Frost and Noval would not seek terminal extubation without obtaining plaintiff's expressed consent beforehand," the complaint states.      Hector claims that on May 6, "Frost told Tapia that she was traveling to a meeting with plaintiff and his counsel and that the family 'plans to move forward with the extubation [the next day].' This was a false and fraudulent misrepresentation. There was no such meeting ever scheduled with plaintiff and his counsel, and plaintiff was never in agreement with extubation." (Brackets in complaint.)

     Hector claims that by then his father had shown "material improvement in his health condition," which Dr. Bradburne noted. He claims Bradburne noted, "'currently, [he] does not meet the ordinary criteria for extubation.'" (Brackets in complaint.)

     Hector adds: "Bradburne never communicated any of this to plaintiff."

     He claims that in a sworn deposition Bradburne was asked if extubation could have been postponed. "He said 'Absolutely,'" the complaint states. "He said that if anyone, including plaintiff, sought postponement, he would have done so. When asked how long he would have postponed extubation, he said 'Now till the cows come home.'" Hector claims that on May 7, moments before his father's terminal extubation, Bradburne told his sisters that their father's condition had further improved: that the pneumonia was clearing, his temperature had returned to normal, the ventilator had been replaced with a CPAP [continuous positive airway pressure] mask, "which meant there were no tubes, just a mask over his mouth and nose", that his father was "in no distress," with normal heart rate, stable blood pressure, and that he was "'awake to voice with eye opening and eye contact for more than 10 seconds.'"

     He says Bradburne gave his sisters "the opportunity to postpone extubation at that moment. They declined."

     Hector says Bradburne tasked Wilson with ensuring that he, Hector Noval, was aware of his father's terminal extubation and that he was still in favor of it. Hector says that Wilson never contacted him; he simply asked Frost.

     "(A)ccording to his note in decedent's medical file, '[Frost] confirmed that her brother Hector has agreed to follow family wishes regarding extubation and has decided not to be present at actual event,'" the complaint states. (Brackets in complaint.)

     Hector says that after his father's breathing tube was removed, Victorino Noval "maintained spontaneous breathing and satisfactory oxygen saturation (93-97%) on this 'simple mask.'" He says Bradburne again gave his sisters the opportunity to postpone their father's death. He says both sisters declined, and Bradburne quadrupled Noval's morphine "to quicken his death" and "effectively ended oxygen support".

     Hector says his father died 4 hours and 40 minutes after being extubated, "after 85 minutes fighting to survive with effectively no oxygen and heavily sedated."

     Hector says he learned his father had died when he arrived at the hospital for a visit that evening. He says his sisters told him that Kaiser "had done all they could and that the decedent had passed away in spite of active treatment, not because of any withdrawal of treatment or terminal extubation."

     "At that point there was no reason to believe any wrongdoing had taken place," the complaint states. "Plaintiff had no knowledge of DPOA, no knowledge of the allegations of Frost and [Tania] Noval to defendants, and no knowledge of defendants' withdrawal of treatment and terminal extubation. He wasn't even aware of decedent's material improvement over the final days of his hospitalization. No one had communicated any of this to him. The only communications he received were from Frost and [Tania] Noval representing that decedent was gravely and terminally ill, that he was in agony, and that there was no likelihood of survival." (Brackets not in complaint.)

     Hector says he learned of the durable power of attorney after his sisters' attorneys produced it with other estate planning documents they had been concealing. Only then, he says did he order his father's medical records from Kaiser and discover the facts.

     Hector claims that in sworn depositions, both Bradburne and Tapia stated that Kaiser's policy is "to do all that is necessary to inform healthcare agents of their rights and responsibilities under a DPOA. They described past incidents wherein they would even search distant states and foreign countries for health-care agents and would even reach out to health-care agents through intermediaries and agents-of-the-agent. They testified with no doubt that defendants would go to great lengths to communicate with healthcare agents about their rights and responsibilities under a DPOA. It's that critical to a patient's care. Yet in this instant matter, defendants knew plaintiff, had his contact information, spoke to him and/or his family members multiple times, and had every opportunity to communicate with plaintiff about the DPOA and his rights and responsibilities therein, and they failed to perform even minimal diligence and due care in doing so. They undoubtedly wanted to believe Frost and [Tania] Noval and 'buried their heads in the sand.' This directly and legally caused the death of a relatively healthy, wealthy man with many more years left to live and love." (Brackets not in complaint.)

     Hector Noval seeks damages and punitive from all the defendants on claims of willful misconduct, negligence, elder abuse, fraudulent concealment, constructive fraud, breach of fiduciary duty and wrongful death.

     He seeks damages from Kaiser and Tapia for fraud and false promise; and damages from Kaiser and Bradburne for medical battery and lack of informed consent.

     The corporate defendants are Kaiser Foundation Health Plant, Kaiser Foundation Hospitals, and Southern California Permanente Medical Group.

Today marks the first day of the trial of convicted felon Victor Noval's sisters Lourdes Frost and Tania Noval about their involvement in the wrongful death of their father Victorino Noval. It is alleged that Victor and his sisters Lourdes and Tania conspired together to kill their father Victorino Noval so they could get their inheritance money sooner. Victorino trusted his son Hector and gave him power of attorney along with his sister Lourdes Frost to make medical decisions on his behalf if he were ever unable to do so. Unbeknownst to Hector, Lourdes allegedly lied to the doctors about Victorino's health and condition. Ultimately Lourdes alone ordered the doctor to give her father Victorino fatal drugs which killed him. This article sums it up well. The greed and avarice is too revolting for anyone to even imagine. Ultimately Hector found out what had happened then he sued his siblings and the hospital for wrongful death. We will be following this trial very closely.

What's interesting in this case is some of the witnesses requested immunity in exchange for their testimony. That means they know what they say could implicate themselves in the wrongful death.
