Illegal immigrants have a positive net effect on the US economy - Mary Cummins, Los Angeles, California

I see many people stating that illegal immigrants are a drain on the economy and society yet they never quote any statistics. What is the real net effect of illegal immigration? It's actually positive for the economy overall.

New York Times 2013 article "Do Illegal Immigrants Actually Hurt the US Economy?" http://www.nytimes.com/2013/02/17/magazine/do-illegal-immigrants-actually-hurt-the-us-economy.html?_r=0 The next effect of illegal immigrants is POSITIVE. Let me try to explain in more detail than the article.

My family owned a construction salvage yard. We employed illegal and legal immigrants. THEY ALL PAID TAXES. In order to work for us they needed a Tax Payer ID number. These numbers are given to illegal, legal immigrants who need them to get a job and can't get a social security number. Payroll taxes are taken out of their salaries including SSI. They pay taxes and file a tax return.

One major thing most people don't know is that while they pay into the system they can't always take out of the system. They pay into social security but generally can't take money out of social security. Just think how upside down our social security would be without immigrants paying into the system?

Illegal immigrants also pay sales tax on everything they buy. While they may be poor they are major consumers. Many American owned businesses rely heavily on the purchases of illegal immigrants. They also pay check cashing fees, payday loan fees, hard money loans to buy a home and cars. If they own property, they pay property tax. Yes, they can buy a house and pay property tax. Property tax pays for schools, roads, public services.

Illegal immigrants are generally unskilled uneducated laborers. These people are willing to do the dirty, heavy lifting, hard work jobs such as construction work, maids, nannies, day laborers, janitorial, gardening, tree trimming... I have never seen a white American in line with the day laborers. I've never seen a white maid walking up the street to work. They have all been illegal Mexican immigrants.

While these illegal immigrants live here they pay rent, buy food, pay for utilities just like the rest of us. When they pay rent they are indirectly paying property tax which pays for schools, roads, government agencies and social services. If they own a car they pay to buy it, pay sales tax on the purchase/sale, pay for maintenance, repairs, insurance and gas. They are paying into the system just like we are.

Some say that some illegal immigrants get free education for their kids. It's not free. They pay rent or property tax while they live here. Some say they get free Medi-Cal, food stamps, welfare. This is completely false. They don't qualify. Even if they were legal immigrants, they still have to live here for five years to qualify. Most who are ill or injured go to cheap or free privately run non-profit clinics. They pay cash at the cheap clinics. They don't want to go to a hospital for fear of being deported.

Here is another great article on the five main illegal immigrant myths debunked. They pay taxes. They don't take American jobs. They provide much needed unskilled labor. They are not a drain on the system. They pay property, sales, sin, transfer...taxes as major consumers of American businesses. http://money.cnn.com/2014/11/20/news/economy/immigration-myths/

A last myth is that they are "criminals, drug dealers and rapists." The FBI stated that most crimes are committed by white male citizens. This is from 2012. It would make more sense to look at crime per person of each race. https://www.fbi.gov/about-us/cjis/ucr/crime-in-the-u.s/2012/crime-in-the-u.s.-2012/tables/43tabledatadecoverviewpdf

The reverse is actually most likely the truth. Because they are illegal they don't report crime against themselves. They are most likely to be the victim of crime because people know they will never report it. They've been the victims of muggings, robbery, assault, rape and murder. They've also been the victim of fraud most likely by employers, vendors. Again they don't report it. Many people rip them off especially in construction jobs. If they don't have a contractor license or work for someone who does, they can't win a lawsuit or collect.

I may post more articles. It's frustrating to see people not know the reality of illegal immigrants. Donald Trump is spreading mass misinformation about illegal immigrants. He is really one to talk as his grandfather was an immigrant and not a naturalized citizen for seven years. Almost everyone in Donald Trump's family is an immigrant including two wives.

We need a better process for making these people legal immigrants. They will be here no matter what because we need them as workers.

A last note "illegal immigrants" are not necessarily "illegal immigrants." It's illegal to enter the country illegally. One can enter the country with work, student, tourist visa then over stay your visit. That would be a civil violation and not criminal.

Josias Gonzalez,

I am a real estate appraiser and expert witness with over 30 years of experience in California. I wrote and lobbied to get an amendment to Los Angeles County zoning to allow wildlife rehabilitation in 2006 i.e. Ordinance 2006-0019 amending section 22.08.180 ( http://planning.lacounty.gov/assets/upl/data/ord_drp-wild-animal-ord.pdf ). I wrote and lobbied to change the wildlife policy for the City of Los Angeles so it would comply with Fish & Wildlife regulations in 2004 ( http://www.businesswire.com/news/home/20040824005654/en/City-Los-Angeles-Approves-Wildlife-Policy ). I have been a real estate expert for noise and animal legal cases for 30 years. I am familiar with legally acceptable sound levels and planning and zoning issues as they relate to all types of animals including exotic, wildlife, farm or domestic animals.

I am also President of non-profit Animal Advocates in Los Angeles. Animal Advocates rescues ill, injured and orphaned native wildlife for release back to the wild. We have rehabilitated coyotes, bobcats, foxes, raccoons... We have also rehabilitated a wolfdog with guidance and help from Lockwood Animal Rescue Center. We highly recommend their center.

We have worked with Dr. Lorin Lindner, Matthew Simmons and their veterinarian Dr. Jennifer Conrad for over ten years. My volunteers and I have visited the facility quite a few times. Their facility has always been very well maintained, clean and secure.

As a real estate expert I can confirm that their facility does not have a negative impact on the neighbors or neighborhood. I support Lockwood's application for a conditional use permit. I am willing to testify to this at the public meeting for the conditional use permit. Feel free to contact me if you have any questions.

Sincerely,

Mary Cummins

Mary Cummins wins Kathy Knight-McConnell lawsuit

On July 7, 2003, Kathy Knight-McConnell sued Mary Cummins for securities law violations, trademark infringement, defamation, and other claims in federal court in New York. At the time of the litigation, Knight-McConnell ran a forum for investor discussions and published a newsletter on various stocks. According to a court decision in the case, Cummins, a stock trader from California, posted statements on website discussion groups and on her own website describing Knight-McConnell as a securities fraud "criminal" and "paid to lie to investors," among other things.

In addition, Knight-McConnell alleged that Cummins intentionally maligned certain stocks that she promoted in order to drive their price down in violation of the securities laws. Knight-McConnell also claimed that Cummins violated trademark law by linking to Knight-McConnell's website without permission, using Knight-McConnell's name in the post-domain path of URLs for seven of her web-pages, and posting links on Internet chat forums and discussion boards directing users to visit these pages.

In a July 2004 opinion, Judge Naomi Reice Buchwald dismissed the securities and trademark claims. The court indicated that Knight-McConnell had no standing to bring a securities law claim because she did not allege that she purchased or sold the stocks in question in reliance on any statement by Cummins. The court dismissed the trademark claim because linking to Knight-McConnell's site without permission was not likely to cause confusion as a matter of law:

"Even if we assume that plaintiff's name is a valid and protectible mark, plaintiff has not alleged that the defendant engaged in any conduct that is likely to cause confusion as to the origin of the defendant's website. The mere appearance on a website of a hyperlink to another site will not lead a web-user to conclude that the owner of the site he is visiting is associated with the owner of the linked site. This is particularly true in this case because defendant's website advertises real estate and web design services, not investment services, and defendant is continuously dissassociating herself from plaintiff by criticizing her and accusing her of misconduct."

Judge Buchwald also determined that using Knight-McConnell's name in URL paths was not likely to cause confusion as a matter of law because a URL "merely shows how the website's data is organized within the host computer's files" and does not suggest affiliation, source, or sponsorship.

Looking at Knight-McConnell's many state law claims, Judge Buchwald determined that the complaint likely stated a cause of action for defamation, but that a defamation claim was not sufficient to confer personal jurisdiction on the court. Buchwald indicated that Knight-McConnell's tortious interference with contract claim might be sufficient to establish jurisdiction under New York's long-arm statute, but that Knight-McConnell had failed to adequately plead this cause of action. The court dismissed the complaint without prejudice and granted Knight-McConnell permission to amend her complaint.

Knight-McConnell amended her complaint, but, upon a renewed motion by Cummins, Judge Buchwald dismissed the case for lack of personal jurisdiction in June 2005.

Independent review of the case by Citizen Media Law Project. I have no idea why these people had an interest in this frivolous case. Of course this was the very beginning of internet law.

Mary Cummins is a real estate appraiser in Los Angeles, California. She also advocates for the protection of investors from stock scams especially those perpetrated by company paid stock promoters. She aided the SEC in their prosecution of stock promoter John Westergaard in 2000 and 2001. She also warned investors about stock scams involving the following companies, TMOT Titan Motorcycle Company, EZR Easyriders, UMCC Ultra Motorcycle Company, NPCT Nanopierce, JNOT Jag Notes and others.

Kathy Knight-McConnell was a company paid stock promoter at the time of the lawsuit. She worked for Nanopierce symbol NPCT. NPCT was never profitable.

Here is her old website. I saved copies of all of it. Click "about" to see her photo of herself. Click "boycott raging bull" to see how she feels about me. Click "NPCT" to see her paid tout job.

I wish I could find her original complaint. I had to read it three times just to try to figure out what the hell she was suing me for. It was all over the place. Finally figured it out and replied.

May 25, 2004. MEMORANDUM IN SUPPORT OF

JURISDICTION, IMPROPER VENUE, and FAILURE TO STATE A CLAIM

Knight-McConnell then filed a motion to strike my motion to dismiss claiming I had a ghost writer. March 25, 2005 Judge Naomi Reice Buchwald orders me to "send an affidavit attesting to the fact and explaining how you obtained the legal scholarship that is reflected in the motion papers." It's called being stressed out of your mind that you are being sued so you stay up many long nights researching how to write and file papers. This was also my second pro se lawsuit as a defendant. I was previously sued for something similar in a Philadelphia court, see Ashton Technology vs Mary Cummins. I learned a lot from JohnDoes.org . They pointed me in the right direction to similar cases. I also learned a lot from Silicon Investor "Investment chat board lawsuits" thread. A lawyer did not write any of my documents or help me in any way.

April 26, 2005. The judge is satisfied with my affidavit. Plaintiff's motion to strike defendant's motion to dismiss is denied.

Knight-McConnell filed an amended complaint and I replied

PIKE & FISCHER INTERNET LAW & REGULATION review of case. Note, I never had to pay any fees because the court never had jurisdiction over me. I should have never been served in the first place. The final current docket reflects this. I'm amazed they wrote such a lengthy article about this frivolous case. This was the beginning of internet law so maybe that's it. Or maybe it was because it was a pro se vs a pro se?

I found my old due diligence page for Kathy. None of the links work. Note, the photo of Kathy in question was posted on the main page of her own website. I added the "toxic funding is awesome!" part, that's it. This is a photo she herself had on the main page of her website.
