He was no saint but he still did not deserve being violently attacked while he was seatbelted in his car. Below is his criminal rap sheet from Nobles County Minnesota. Here's the video for those who haven't seen it. If you watch after he's put in the car, he cries then he's fuming mad yelling at the officers who can't hear him as they are outside. He says he works for PCA with his grandma. PCA is Personal Care Assistant.

Here is a link to the pdf of the complaint against him. This whole thing started because an off duty police officer recognized him from previous contact. He called in to an on-duty officer to check to see if his revoked license was restored. It wasn't. The officer started to follow then allegedly Promvongsa acted like a little dick driving his car in a threatening manner but never harming the off duty officer or his car. I highly doubt Promvongsa would verbally threaten an officer off duty or not. That's just too stupid. I think maybe that was made up to rationalize his treatment. Of course that guy was off duty so there's no dash or body cam, convenient. Does an off duty officer even have the right to call an on duty officer to ask if a civilian had their driving privileges restored?

I believe his father is Promvongsa, Saengthong, Worthington, Minnesota who also has a record for driving after revocation, $290.

There is another person with his same name who also has a criminal history. Relative? They were charged in that same city with a felony. I don't know why it wouldn't have shown up in my last search.

This is a Facebook page with same name living in same city. I'm not certain it's him but it looks like him. His relatives are friends with this profile. This person and his friends flashing CRIP gang signs talking about racing hot cars. Even if he is a little shit, he didn't deserve to get beaten. He may have been inciting the officer but the officer still has to control himself.

I think it's his uncle Kingkeo Promvongsa who also has a criminal record for domestic abuse, property damage. This family needs some major counseling. STATEMENT OF PROBABLE CAUSE

The Complainant states that the following facts establish probable cause:

The complainant, a licensed peace officer in the state of Minnesota, is aware of the following through the complainant’s own investigation and experience and that of fellow peace officers.

On July 28, 2016 at approximately 9:30 a.m. Officer Colby Palmersheim of the Worthington Police Department was parked on 12th Street and 2nd Avenue in Worthington. Palmersheim was off duty at the time. Palmersheim saw a silver Honda Pilot bearing Minnesota license plate number 618UGL. As the vehicle passed by him, Palmersheim recognized the driver as Anthony Promvongsa, DOB: 08/16/1994. Palmersheim knew Promvongsa from prior police contacts.

Palmersheim proceeded onto south 2nd Avenue and then onto west 9th Street when he observed Promvongsa approaching from behind at a high rate of speed. Promvongsa was so close that Palmersheim could not see the hood of Promvongsa’s vehicle. Palmersheim estimated that Promvongsa was within 1-3 feet of his rear bumper.

As they approached 7th Avenue, Promvongsa traveled to the right side of Palmersheim. Palmersheim thought Promvongsa was attempting to pass him so he moved over slightly. Promvongsa swerved toward Palmersheim’s vehicle. Promvongsa then slowed down and proceeded to follow close behind Palmersheim’s vehicle. Promvongsa pulled up to the side of Palmersheim’s vehicle but remained near Palmersheim’s rear driver side fender. Promvongsa continued to tailgate Palmersheim. Palmersheim saw Promvongsa stick his hand out the window and make some type of motion.

 This type of driving behavior continued until Palmersheim stopped at the stop sign at 9th Avenue and Winifred Street. At that point, Promvongsa backed off a little. Shortly thereafter, Promvongsa once again came up upon Palmersheim’s vehicle at a fast rate of speed. Palmersheim thought Promvongsa was going to run into the back of his car but Promvongsa stopped quickly, within inches of Palmersheim’s bumper. Palmersheim saw Promvongsa make additional motions with this hand out the window.

Promvongsa continued to follow Palmersheim closely as Palmersheim traveled onto Winifred Street, and then Lake Avenue and Shell Street where Palmersheim parked his vehicle. Off duty Officer Mark Riley of the Worthington Police Department was at this location. Palmersheim got out of his vehicle and grabbed a pistol from his driver’s seat because Palmersheim believed Promvongsa was attempting to harm him. Palmersheim put the pistol in his pocket when he got out of his vehicle. Promvongsa drove between Palmersheim’s and Riley’s vehicle at an unreasonably high rate of speed. Promvongsa then pulled into a driveway, turned around and pulled up to Palmersheim and Riley. Promvongsa rolled down his window and told Palmersheim and Riley to stay there as he was going to go get his boys and come back to get them. Promvongsa sped away at a high rate of speed.

Riley was aware that Promvongsa’s driving privileges were revoked and called dispatch to report the incident.

Agent Joe Joswiak of the Buffalo Ridge Drug Task Force checked Promvongsa’s driving status which showed he was revoked on March 28, 2014 and had not been reinstated. Joswiak also noticed that Promvongsa received a ticket for driving after revocation on July 21, 2016 and the reports indicated that Promvongsa was confrontational at the time of the traffic stop. 3

Joswiak canvased the area where Promvongsa had last been seen. Joswiak saw a dark grey Honda Pilot on Lake Avenue near Chautauqua Park. As the Honda Pilot approached Joswiak the driver swerved toward Joswiak’s vehicle. Joswiak had to pull quickly towards the curb to avoid colliding with the Honda Pilot. When the vehicle passed by, Joswiak recognized the driver as Promvongsa. Joswiak knew Promvongsa from previous police contacts. Joswiak believed Promvongsa knew of Joswiak’s unmarked vehicle.

Promvongsa turned around in a driveway and drove past Joswiak. Joswiak turned on his squad’s emergency lights and sirens as he followed Promvongsa onto Winifred. Promvongsa did not stop but continued onto 9th Street. Joswiak informed dispatch that he was in a pursuit because the suspect vehicle was not stopping.

Sgt. Tim Gaul of the Worthington Police Department assisted in the pursuit in his marked squad car. The officers stopped Promvongsa on 9th Street between 4th and 3rd Avenue. Joswiak drew his duty weapon as he approached Promvongsa’s vehicle and yelled for him to get out of his vehicle. Promvongsa did not comply. Joswiak walked up the driver’s side door and opened it ordering Promvongsa to get out of his vehicle. Again, Promvongsa did not comply so Joswiak grabbed ahold of Promvongsa and told him to get out. Joswiak delivered several knee strikes to Promvongsa in an attempt to gain control of him but Promvongsa continued to resist getting out of his vehicle. Joswiak was not sure if Promvongsa was armed or had any concealed weapons in the vehicle. Joswiak delivered a straight punch to Promvongsa and eventually was able to pull him out of the vehicle. Once outside, Promvongsa was handcuffed and detained on the ground.

Promvongsa was arrested and transported to the Nobles County Jail by Sgt. Gaul. At the jail, Gaul searched Promvongsa’s person finding a Marlboro box that contained a small amount of green plant substance. Gaul believed through training and experience that the green plant substance was marijuana. Later Joswiak field tested the green plant material which was positive for marijuana.

A search warrant was obtained for a blood sample from Promvongsa as it was believed he may be under the influence of a hazardous substance due to his driving behaviors and because marijuana was found on his person. The blood sample will be sent to the Bureau of Criminal Apprehension for testing.

"Video recently obtained by the Minnesota chapter of the ACLU shows Buffalo Ridge drug taskforce agent Joe Joswiak initiating a traffic stop with his gun leveled at the driver’s seat of the vehicle, shouting expletives at the driver, and violently removing him from the vehicle – seemingly before he had a chance to comply with the officer’s commands.

“I had no idea what was going on when I was approached and attacked by this officer,” Anthony Promvongsa, the man being arrested in the 2016 footage, told the ACLU.

Within six seconds of first ordering Promvongsa out for the vehicle, Joswiak had opened the driver’s side door and began pulling the man out, repeatedly kneeing him and throwing a number of punches.

The video was captured from a different officer’s dashboard camera. Shortly after the violent arrest of Promvongsa begins, the audio cuts out; the ACLU says it was intentionally shut off by the second officer as Joswiak hurled abusive language at the man.

“I did not even have the opportunity to take off my seatbelt before I was literally blindsided with this unnecessary attack,” Promvongsa said. “I immediately pulled over for the Worthington [Minnesota] squad car and before I knew what was happening I was beat and ripped from my vehicle. I know I am not the first person to have this type of traumatic experience with law enforcement in Worthington.”

He added: “This type of violence with community members has to stop. This encounter was demoralizing and has left me scared of future interactions with the police.”

Teresa Nelson, executive director of the ACLU of Minnesota, said that the branch was calling for an investigation of Joswiak’s behavior and “for him to be held accountable for his brutal attack on Anthony Promvongsa, up to and including termination and prosecution”.

“Thus far Agent Joswiak has received no punishment for this abhorrent treatment of Anthony,” Nelson said. “This sends a message that the department condones the officer’s behavior, which it should not.”

The incident began when an off-duty officer called in a report that Promvongsa was driving recklessly. Prosecutors charged Promvongsa, a Laotian American, with assault with a dangerous weapon (a motor vehicle), one count of fleeing an officer in a motor vehicle, possession of a small amount of marijuana and driving after revocation. His case is still pending, and no trial date has currently been set.

In a joint press release, local authorities called the video “one piece of evidence in a pending criminal case”.

“The video, viewed in a vacuum, shows only a short segment of the incident that is the basis of the criminal charges,” said the statement from the Buffalo Ridge drug task force, the Worthington police department and the Nobles County attorney’s office.

Joswiak did not immediately respond to a request for comment by the Guardian.

The accusation comes just days after another Minnesota officer, Jeronimo Yanez, was acquitted in the shooting death of Philando Castile."
