11212024 Supreme Court ruled today that the government accepted a plea deal and had to honor it. They did not rule on the merits of the case because Jussie did not argue merits of the case. He is still guilty of those crimes in the eyes of the law. This is the same way Bill Cosby got his case dismissed. Now Jussie will be running around claiming he was innocent and cleared of all charges but that is not the case at all. He already severely damaged his reputation. Everyone now knows that the guy's a major liar who is willing to say any racist, homophobic thing to try to help his career to make money. A very sad human being.

02/06/2024 Jussie Smollet lost his federal appeal and is now appealing to Illinois Supreme Court. His current argument is he had a plea deal which was approved but rescinded. To charge him after that is allegedly double jeopardy. Clearly the state can retract plea deals. They do it all the time. Defendants go on to be tried and found guilty. Smollett was already found guilty at trial. He should have admitted guilt and said a big I'm sorry a long time ago and this would be over by now but no. He took the plea then loudly proclaimed his innocence and called the prosecutors and everyone else liars. They had video, actual receipts, statements from the two guys involved in the "act." Guilty a charged.

04/19/2022 Sherri Papini was sentenced today for a similar fake crime. She lied and stated she was kidnapped by two Latino women. She wasn't. She planned and staged the fake kidnapping just like Jussie Smollett and his fake hate crime. This article goes into the possible psychological issues and motivations. It's very similar to Jussie's case. Sherri had bindings she put on herself when found just like Jussie's noose. This woman lied about it from 2016 to 2020 and only very recently came clean. Let's see how long it takes Jussie.

"As a possibly related factor, Lamoureux has researched the false hero or “pathological hero” phenomenon that takes advantage of society's treatment of victims as heroes. Those who fake their own victimization may be seeking recognition or popularity, and if mental illness is involved it may suggest a narcissistic or histrionic personality disorder.
Another possible explanation is that she faked her kidnapping to avoid some other adverse consequence, he said, typically something like a divorce or being fired, though Papini was a stay-at-home mom.
Lamoureux, who specializes in complicated criminal and civil cases, said manufacturing a crisis may be a way for those with fragile egos and poor coping skills to seek to prevent the bad outcome from happening.
And there are such things as compulsive liars, as well as those who do “not have a great distinction between fantasy and reality,” sometimes because of an earlier trauma, said Dr. Ziv Cohen, founder and medical director of Principium Psychiatry in New York City.
This case is unusual in that Papini had no clear motive and “this is consciously creating some kind of false traumatic situation,” said Cohen, who teaches at Weill Cornell Medical College and Columbia University. “She harmed herself — she wasn't actually abused by anyone.”
But for some pathological liars the motivation is simply in fooling others, he said, in this case perhaps her husband and investigators.
“These patients can sometimes remain quite mysterious and they often can deny their lies right until the end,” Cohen said. “They will persist and say in the face of all evidence that their version is true.” "
Sherri stated this today. Wonder if Jussie will ever get to the same state. I stupidly believed both of these frauds originally even though both stories were shady AF from the beginning. I personally think Jussie's story is worse because of the fake racist hate crime charge. Jussie even went after the people he paid to commit the "crime." Jussie is the bigger narcissist.

03/16/2022 10:00 pm PST and he's no longer listed in jail. Jussie will be released pending appeal as soon as he posts a bond. 4:50 pm PST he's still in jail. The finding is that he was convicted of a non-violent offense. His sentence would be over by the time his appeal is heard. What will he do when his sentence is confirmed? Maybe he'll finally confess and apologize.

03/15/2022 Jussie's siblings are using his Instagram to post video messages here. They're telling people to bombard the jail with negative press, phone calls, calls to free Jessie.
Jussie was just moved out of the psych ward. He was allegedly in a restrained bed per TMZ news. The previous paperwork said he was at risk of self harm. Who knows what the truth is as Jussie, his family lie and his attorney lie. Jail location was changed to DIV8-3S-3103-1. It was DIV8-2SE-2155-1. "Division 8 is the Residential Treatment Unit (RTU) where detainees with injuries and medical conditions are housed." "Built in 1978, Division 8 RTU Annex is a two-story building with 24 wings and a capacity to hold 992 detainees." It's the minimal security hospital unit.

03/14/2022 Jussie's legal team filed a motion to release him from jail immediately. They claim he could die from Covid because of his compromised immune system and current health status. Doctor doesn't mention what exactly is his current health status. The doctor would have to state what it is if he's going to mention it.

They also argue that he's in protective custody which is akin to solitary confinement. That's false. Protective custody means he's just not mixed in with the prison population. He is around guards and jail employees. I'm sure he also has access to mental health care and can talk to his lawyers, family on the phone. If Jussie had admitted to what he did and apologized he may not have gotten jail time.
Current Pacer cases. The first two are the same. Gomez is suing Smollett, the Osundario brothers and Kim Foxx for RICO racketeering. Gomez was a lawyer but has been suspended from the practice of law. The first case was dismissed for lack of subject matter jurisdiction. It was appealed.

03/13/2022 Jussie has been placed in the psych ward allegedly for fear of self harm. Maybe it's because they fear he'll harm himself and claim someone else did it. Sorry, but with his history of lying and faking harm against himself it's hard to believe a word he says. Law enforcement just said that he's in the psych ward because that's where they house high profile inmates. Now that makes sense. Jussie has already harmed himself almost more than anyone else could harm him.
The Feds have declined to also charge Jussie with sending a fake racist hate letter threatening to kill himself. They feel his sentence for faking the hate attack is sufficient. They don't want to pile on. Jussie allegedly sent this to himself before he staged the fake hate crime. He staged the fake hate crime because he felt he didn't get enough attention from the letter. This letter is so embarrassing. I'm sure the city of Chicago will also drop the civil suit against him because they were awarded restitution for their investigation.

There was so much overwhelming physical evidence and eye witness testimony. Jussie needs mental health help. His narcissism is extreme to the point he has to deny reality to himself. 03//10/2022 Jussie Smollett was booked into Cook County Sheriff Department's jail today. Booking number 20220310140. Link to his booking photo. He did this to himself. He is an arrogant narcissist. They say narcissism can't be cured but therapy can help. Narcissists are generally very insecure inside. Clearly he was to have needed so much attention and to go to the extremes that he did to get it. He destroyed his family, the TV show Empire, cast members, friends, his career, reputation all for some attention. The way he sought out that attention was the absolute worst way imaginable. To use race, sexual orientation and politics to try to stir up such conflict and divide was horrible. I totally believed him originally. He abused everyone's trust.

Your honor I respect you and I respect the jury but I did not do this and I am not suicidal. And if anything happens to me when I go in there, I did not do it to myself, and you must all know that. I respect you, your honor. I respect your decision, but jail time (shakes head). I am not suicidal." Judge: "Defendant is remanded to the custody of the county sheriff." Cuts off mic. Jussie continues to yell "I am not suicidal!" with a raised fist as he's escorted out of the court room.
I'm shocked. I really thought he'd just get probation. He did commit perjury on the stand in a court of law. He could have gotten ten years just for that. He lied to city, county, state and federal officers which is a bigger crime. He was indicted by two grand juries. He was found guilty of 5/6 charges. I would bet he gets released from county jail early. (He won't be in isolation because this jail got rid of isolation. He won't be in contact with other prisoners. He will have plenty of staff around him the entire time. They are wearing body cameras. He won't be confined to his cell all the time. Judge is finally talking! Sheila ... asked for a special prosecutor to be appointed to investigate the case. Another Judge took it under advisement. There were two grand juries and two indictments. Defendant was found guilty. Sentencing range. Lowest class felony in state of Illinois. Possible probation 30 months, time of 180 days in county jail, community services, behavior classes, restitution, fine, penitentiary sentence of 1-3 years. There are five counts but Judge doesn't think it could be consecutive sentences.

"You called the prosecutor out for quoting you for saying the n word." (Smollett interrupts special prosecutor Dan Webb as Webb was reading aloud one of Smollett's messages that had N word in it. Jussie said, wrote, texted the n word himself and the prosecutor was merely quoting him. Smollett: "can you spell or say the N word out of respect for every African American in this room? you've been saying that word a lot.") Here is link to crazy thing Jussie did. It's astonishing you would say that then hoax a hate crime. Some say you did it for the money. You were making $2,000,000 a year. I don't think so. You really craved the attention. You are involved in social justice, you knew this was a sore spot right now in this country, and you did it to make yourself more famous. It worked for a while. You betrayed social justice issues. You are arrogant, selfish and narcissistic. Judge said he damaged people affected by real hate crimes. You have done some real damage.
This was premeditated. You have that dark side. You wrote a script. You chose your loyal friends, the brothers to do this. You paid them by check. You chose the date, time, location, props. You gave them cash to buy the supplies. Aggravating factor because so premeditated. 2 am in Chicago in a winter vortex double digits below zero and still went ahead of it. Judge called the brothers "patsies."
You lied to the police. You caused a major investigation. That's why you're here now. You repeated lies. Overwhelming evidence of guilt against you. You of all people who knew better, who worked for social justice causes faked a hate crime, a race crime. You knew people would react because of your activism and being an actor. You knew you would create a huge situation. You got the pity party you wanted. You were on the front page. You used everyone. You damaged them. It's disgraceful.
Everyone in Chicago knows crime is a problem. Police resources are limited and precious. They can't be squandered. What you did you did because you're selfish, arrogant, narcissistic, you used the resources for your own benefit. You created a heater. Public was shocked about the case. They demanded that police and everyone investigate the case. The amount of police work in this case was more than a murder case. You didn't want the case "solved." It didn't go down like that. Police solved the case.
You're not a victim of a race crime, hate crime, homophobic hate crime. You're a charlatan. It's shameful. The damage you did to yourself is beyond what can happen to you from me. You are now a permanently convicted felon. You put your family, friends through a ringer. You embarrassed them. You turned yourself from riches to rags. You name is an advert for lying. Now lying is "pulling a Jussie." They do TV skits about you, all self inflicted, self damage. It's not funny.
We're at the end. It's probational but we have aggravating factors, premeditation, pain caused to city, victims of hate crimes. I'm mindful request of city's restitution. Jussie's attorney said "black people are watching" almost like a threat. He quoted the bible. He said he could die in jail from Covid. It could be a "death sentence."
This may be a long hearing as they are allowing many people to speak. Everyone is asking for probation and not jail time including his lawyers. Jussie is crying and holding his hands. Jussie's Jewish grandmother Mollie at 92 years of age spoke. She said "please, don't send him to prison. If you do, send me too." She was the last speaker. I feel so bad for her. Hope she doesn't have a stroke or anything.
Time for argument and other presentations. Judge received many letters asking for mercy for Jussie. Defense will read some letters stating who wrote them. Letters state "Jussie committed a low level, non violent crime. He should get community service and not prison."
They keep stating he has been vilified. His reputation and career were severely damaged. I feel he deserved that as it was the result of his own behavior. He should has fessed up, apologized and he wouldn't have been as damaged. If he didn't do it at all, he wouldn't have been damaged at all. He still denies everything. Judges, Courts don't like that.
Sentencing is happening now. I predict no jail time but delayed jail time and probation. He may have to pay for the investigation but I'm not sure if restitution is part of this hearing, case.
In his documents Jussie blames everyone and their brother for his own behavior. He "weaponized race" in his docs. Oddly enough people who spoke for him and wrote letters only asked the judge for mercy in the sentence. They all stated the crime was a non-violent class 4 felony and the only victim was the city. They expressed fear if he is sent to jail.

Judge Virginia M. Kendall rejected Smollett’s contention that he should not be made to pay $130,000 in police overtime costs, plus $260,000 in damages, because he could not have foreseen how seriously the police would take his hate crime report. The judge also faulted Smollett’s attorneys for its “attempts to muddy the waters with irrelevant arguments.”
Smollett told police on Jan. 29 that he had been assaulted on the street by two men who shouted racial and homophobic slurs, poured bleach on him, and shouted that this was “MAGA country.” The Chicago Police Department engaged in an intensive investigation, ultimately concluding that Smollett had staged the attack.
Kendall held that the intensive investigation was foreseeable, especially given the combustible nature of the allegations.
“The natural, ordinary and reasonable consequence of a police report like this one — a racist, homophobic physical assault in which masked attackers invoked the President of the United States’ official campaign slogan — is an intensive, sprawling investigation like the one that took place,” Kendall wrote. “Smollett contends that police overtime pay is not ‘foreseeable in the normal course of events,’ but this is hardly the normal course of events — most crime victims, for instance, do not have the opportunity to discuss the crime on ‘Good Morning
America.’ The allegations were taken seriously by the Chicago Police Department in significant part due to the high profile of the claimant and the extreme nature of the accusations.”

05/31/2019 More details from police records. Smollet said to the police that the brothers could not have committed the crime because they are "black as sin." Do we have a light skinned racist? Only times I've ever heard that phrase was when it came from the mouths of old white male racists.
Seems prosecutors told the police to stop investigating the case. Prosecutor has no authority to tell the police that. Generally police investigate then give their evidence to the prosecutor who then decides to prosecute or not. The prosecutor didn't even ask for the police's evidence.

Jussie has moved back to Los Angeles "for security reasons." As long as Jussie doesn't pay people to attack him he should be okay ;-)
One petition to investigate has been dismissed by the attorney who filed it. The other remains and will be heard this Thursday. Jussie Smollett has been requested to be at the hearing.
"Former Illinois Appellate Court Judge Sophia O’Brien also filed a petition asking for a probe. Her petition—which also includes a request for a judge outside of Cook County to make the decision on whether or not a special prosecutor will be appointed—still stands, and a hearing is scheduled for Thursday. Empire will have a season six. At the moment Jussie won't be a part of it. Empire did pick up his option. This means he's getting paid something for the possibility to rejoin the show. I'm sure this is because of the investigations and lawsuit against Jussie.
04/23/2019 The brothers just sued Jussie's lawyers for defamation. Here's the tricky thing. If the lawyers made the statements in legal filings, it can never be defamation. If they only made the statements to the press, it can be defamation. The lawyers know Jussie Smollett arranged the attack. They know what they are saying is false. Of course they may lie and state they believed Jussie and thought it was the truth.
In the suit the brothers claim Jussie never told them he was going to file a police report. They thought it was just for social media attention. Oddly the brothers didn't sue Jussie Smollett. Maybe they are hoping Jussie will do the right thing. He won't

04/16/2019 Texts, emails turned over to the Tribune. One text from Kim Foxx to her staff stated "Washed up celeb who lied to cops." The data showed that Foxx office dropped the charges and told Smollett and his lawyer. They in turn told the press that the charges would be dropped at the next hearing which is why the press was there. The police, Mayor did not know the charges would be dropped. They heard it from the many press outlets who were at the hearing.

04/08/2019 Retired Justice Sheila M. O'Brien filed a petition to appoint a special prosecutor to investigate Foxx's handling of the Jussie Smollett case. I'm trying to get a copy of her petition. Justice O'Brien also wrote an op-ed about the case last week which is here.

03/28/2019 This Thursday is the expungement hearing where they will remove the case from Jussie's record. I believe Jussie did the same in Los Angeles when he was caught lying to police, impersonating his brother and driving drunk. I could only find that record in his brother's name and not his name. They should not expunge his record again. Jussie is a repeat offender who lies to police.

Here is the demand letter. It clearly states that Jussie lied to police about being attacked. "On January 29, 2019, you made a police report in which you falsely claimed that two men had attacked you while yelling racial and homophobic slurs. It's getting crazier! Chicago is demanding $130,000 to cover costs of the investigation while Smollett's lawyers are demanding an apology from the Mayor and police chief for "for dragging an innocent man’s character through the mud."

Again, Jussie Smollett was not exonerated. The Mayor and Police said he did the crime. The DA just decided to drop the charges because at the end of a trial Jussie probably would have just gotten community service and paid a fine because he was an alleged first time offender. He was arrested and charged in Los Angeles for lying to police and impersonating his brother when he was pulled over for a DUI.
"According to the city law department, the city of Chicago is seeking "immediate payment" of the $130,000 "expended on overtime hours in the investigation of this matter," adding that if the amount is not paid within 7 days the "Department of Law may prosecute" Smollett "for making a false statement to the City" or "pursue any other legal remedy available at law."
03/27/2019 The brothers are now refusing to tell their story. Empire or Smollett must have given them money. It would have to be over $100,000 because that's what their story would be worth. The brothers' attorney then quit.
Cast of Empire is up in arms over the situation. Most don't want Jussie back on the show. I personally feel having Jussie back on the show would hurt the show.

The DA states that Jussie Smollett was not exonerated. Smollett did fabricate the incident. Smollett will have to pay his two friends a lot of money to keep them quiet. I bet they could get an easy $100,000 for their story. It truly is disgusting that Smollett stated he was cleared of all wrong doing. Not true.

Chicago Mayor and police department are very mad that prosecutors dropped the case against Smollett.

After having the charges dropped Jussie Smollett is still lying about what happened, didn't happened. He should have kept quiet. This is going to backfire for Smollett.
This is a wild one. Below is Jussie Smollett's statement. After that we'll talk about reality. Jussie is either not very bright or he has narcissistic personality disorder. How in the world did he think he would be able to get away with this stunt?
“I would not be my mothers son if I was capable of doing what I was accused of,” Smollett said after prosecutors dropped all the charges. “I’d like nothing more than to just get back to work and move on with my life, but make no mistakes I will always continue to fight for the justice, equality, and betterment of marginalized people everywhere.”
"Cook County prosecutors agreed to drop the charges against Smollett at an unscheduled hearing in the case Tuesday morning. Smollett will forfeit the $10,000 bail he posted after his arrest."
The prosecutors agreed to drop the charges if Jussie Smollett forfeited the $10,000 bail. Judge granted a motion to seal the case. If Jussie Smollett were actually cleared, he wouldn't forfeit the $10,000. The $10,000 is, I believe, to pay for the cost of the investigation. I believe the DA agreed to drop the charges because of the leaks in the investigation. Smollett could have argued that the leaks harmed him. One leak was that Smollett paid $3,500 to his two friends to stage the event. The check actually stated it was for fitness consulting. I believe in reality it probably was for them to stage the event.

Police Supt Eddie Johnson is upset about the ruling. He wasn't even notified. I'm pretty sure this is the result of Smollett's attorney threatening to sue the City over the leak and press conference. I don't think Smollett is innocent. If he were, the two brothers would be arrested. I have no respect for Jussie Smollett at all.
What will be very interesting is if the brothers sell their story. I believe the brothers. Maybe Jussie will strike a deal, settlement with the brothers. I don't believe Jussie Smollett because he has a history of lying to police, see below. I don't believe Smollett is innocent.
03/08/19 It gets even more disgusting! Smollett's attorney Mark Geragos just stated that the police have the two people who committed this crime. Smollett is willing to state that his two black buddies committed the crime against him!! Justin "Jussie" Smollett is truly a disgusting person. He keeps digging his grave. He will not recover from this. He should have confessed earlier. Police already know that Smollett previously lied to police and tried to blame his own brother for his own crime of DUI.
Smollett indicted for 16 felony counts of filing a false police report of a hate crime. They are charging him for 16 counts because he made 16 separate lies. That's 1-3 years in prison and a $25,000 fine for each lie. He does have a prior for lying to police. He's now facing a much longer prison time. Previously it was just one count but they decided to add the lies together. He did waste a lot of police resources but I think the potential of 48 years would be way too excessive. 02/21/2019 I was told Jussie used his brother's name for a DUI in Los Angeles. I searched the court records. You can only find it by searching Jake Smollett. Jussie was charged with DUI, driving without a license and lying to police. Here is the case.

Jussie went to the Empire set and stated as follows.

As the details come out it just gets worse and worse. Jussie kept the noose around his neck for 42 minutes after the assault. Common reaction would be to instantly remove it.

Jussie Smollett was booked this morning at 5:00 a.m. in Chicago. He has a bail hearing later today. His motive for this stunt was to get a bigger paycheck from Empire. Now he'll be getting a lot less. Really dumb move for so many reasons. Police stated he made and sent the hate letter to himself.

BOND PROFFER
Defendant: Jussie Smollett (DOB 6/21/82) – 36 years old Charge: Disorderly Conduct-False Report (Class 4 Felony)
The Defendant Jussie Smollet is an Actor and Singer-Songwriter, who currently appears as a character on the Fox television show “Empire.” Defendant Smollett currently resides in an Apartment in Chicago’s Streeterville neighborhood.
The People expect the evidence to show that:
On Tuesday, January 22, 2019. Defendant Smollett received a written letter at the Cinespacc Chicago Film Studios, which is a facility on the Southwest Side of Chicago where the Empire Television Show is filmed. This letter contained written threats directed toward Defendant Smollett, and contained a then unknown white powdery substance. The letter also contained cut out letters pieced together which stated “Smollett Jessie you will die black f–“, and the word “MAGA” was hand written on the envelope where the return address is typically located. This powdery substance has since been determined to be crushed ibuprofen tablets. The letter also contained a drawing of a stick figure, which appears to have a rope around the neck and a gun pointed at it. Law enforcement authorities were contacted, and the letter was turned over to the Federal Bureau of Investigation, which is currently conducting forensic analysis of the letter.
In January of 2019, and at all times relevant hereto, Defendant Smollett was close friends with an individual by the name of Abimbola “Abel” Osundairo, who is 25 years old. Smollett and Abel initiated their friendship in the fall of 2017. During the course of this friendship, Defendant Smollett and Abel socialized together, exercised together, as well as worked together on the Fox television series Empire. Within that working relationship, Abel was a stand-in for a character named “Kai”, who is a love interest of Defendant Smollet’s character on the Empire TV Show. Additionally, text messages between Defendant Smollett and Abel revealed that Abel was a source of designer drugs for Defendant Smollett. Specifically, since the spring of 2018, on several occasions, Defendant Smollett requested Abel to provide him with “Molly”, which is a street name for the narcotic Ecstasy. Text messages generated by Defendant Smollett to Abel, specifically starting on the morning of January 25, 2019, reveal Defendant Smollett asking Abel when he would be leaving on his upcoming trip to Nigeria. This trip was scheduled to take place on the evening of January 29, 2019, and it had been planned by Abel and his brother Olabinjo “Ola” Osundairo (27 years old) two months prior.
After Abel confirmed the date and time of his trip, Defendant Smollett texted Abel stating “Might need your help on the low. You around to meet up and talk face to face?” The two than made arrangements to meet at the Cinespace Studios that afternoon, where Defendant Swollen subsequently drove Abel home to Abel’s apartment in the Lakeview neighborhood. During the ride, Defendant Smollett indicated to Abel his displeasure with the Empire Studio’s handling of the racist and homophobic letter he received three days prior. Defendant Smollett then stated that he wanted to stage an attack where Abel would appear to batter him. Defendant Smollett also suggested that Abel’s older brother Ola assist him with the attack. Defendant Smollett had met Ola on several previous occasions through Abel. Additionally, Ola had also appeared as an extra of the Empire TV show. Abel and Ola are both dark skinned, black males, born in the United States. with Nigerian decent.
When Defendant Smollett and Abel reached Abel’s apartment at approximately 5:00 PM on January 25, 2019, Ola, who was then living with Abel, was summoned into Defendant Smollett’s vehicle. Once inside, Smollett asked Ola if he could trust him. When Ola said he could, Smollett detailed his plans of the attack to the brothers. Defendant Smollett stated that he wanted them to appear to attack him on the evening of January 28, 2019 near his apartment building in Streeterville. Defendant Smollett also stated that he wanted the brothers to catch his attention by calling him an “Empire F Empire N .” Defendant Smollett further detailed that he wanted Abel to attack him, but not hurt him too badly and give him a chance to appear to fight back. Defendant Smollett also included that he wanted Ola to place a rope around his neck, pour gasoline on him and yell “This is MAGA country.” Prior to the brothers getting out of Smollett’s car, Smollett provided Abel with a $100 bill to purchase the rope, gasoline, ski masks, gloves and red baseball caps which resemble the ones that say “Make America Great Again.” The ride from Cinescape Studios to the Osundairo brothers’ home and the meeting between Smollett and the brothers is corroborated by CPD POD videos and cellular phone tower data of Smollett’s phone number.
On the late morning of Sunday January 27, 2019, Swollen drove his vehicle back to the Lakeview neighborhood to pick up the brothers and show them the scene where he wanted the staged attack to take place. Smollett then drove the brothers to the corner of New Street and North Water Street in Chicago where the staged attack was to take place. This was just outside Smollett’s apartment building. Further details were provided by Smollett which included that the staged attack was to take place near the stairs on the southwest comer of New and North Water Streets at 10:00PM the following night. Smollett also instructed the brothers not to bring their cell phones with them. Smollett directed the brothers’ attention toward a surveillance camera on the corner, which he believed would capture the incident. There was a change in the plan that bleach was going to be used rather than gasoline during the simulated attack. Smollett then drove the brothers home and provided them with a $3500 personal check made payable to Abel, which was backdated to January 23, 2019. On the morning of January 28, 2019, the date of the planned incident, the brothers purchased the clothing items at a local beauty supply store and the rope at a nearby hardware store, using the $100 bill that Smollett had given them. These purchases were corroborated by surveillance video and a receipt. Abel also deposited Smollett’s check that same day in his own bank account. Later that evening, the plan had changed and the time of the attack had to be pushed back because Smollett’s flight into O’Hare Airport from New York had been delayed by four hours. Smollett’s plane eventually landed at O’Hare at 12:30 AM on January 29, 2019. At 12:49 AM, there was a phone call between Smollett and Abel which lasted three minutes. During this call, Smollett told Abel the attack would take place at exactly 2:00 AM at the preset location. Minutes later Ola ordered an Uber ride share to his home to leave for the crime scene. Cell phone records and Uber records confirm this call and the Uber ride.
The brothers then took the Uber to the 1400 block of North Wells where they exited the Uber and flagged down a taxi which took them to within three blocks of the arranged scene at approximately 1:22 AM. The taxi’s in-car video captures the brothers flagging the cab and riding in the back seat.
From approximately 1:22A.M. until approximately 2:03A.M., video evidence showed the brothers on foot in an area bordered by Lake Shore Drive on the east, Columbus Drive on the west, Illinois Street to the north, and the Chicago River to the south. Video evidence also showed that Smollett returned back to his apartment from the airport at approximately 1:30 AM. At 1:45 AM, Smollett left his building to walk to a nearby Subway restaurant at Illinois Street and McClurg Court At 2:00 AM, the brothers were at the intersection of New St. and North Water Street: however, Defendant Smollett did not arrive exactly at the preset time. The brothers then proceeded a quarter block north and waited near a bench until Smollett arrived, which was four minutes later. Surveillance cameras captured the brothers waiting at this location just prior to the staged attack. During Smollett’s interview on ABC’s Good Morning America which aired on February 14, 2019, he identified the people shown in a still of this surveillance video as his attackers. Also, during this interview, Smollett indicated that he was positive that these were his attackers. The two men in this video are in fact that Osundairo brothers.
It was at this time, that the brothers staged the attack of Defendant Smollett just how Smollett had instructed them. While the staged attack was occurring, a witness, who is an employee of NBC News Chicago, had just parked and exited her vehicle just around the corner from the location of the staged attack. This witness indicated that she heard nothing at the time the staged attack was occurring, despite the fact that Defendant Smollett told CPD detectives that his attackers were “yelling” racial and homophobic slurs at him, and he in turn was “yelling” back at them. The staged attack lasted 45 seconds, and it was just outside the view of the desired nearby camera that Smollett had pointed out to the brothers approximately 15 hours earlier.
Approximately one minute later, video evidence showed the brothers run from the location, southbound toward the Chicago River and westbound toward Columbus Drive. Video evidence also captured the brothers entering a taxi at the Hyatt Regency Hotel across the river at 02:10 A.M.
Video evidence then showed that at 2:25 AM, the brothers exit the taxi on the 3600 block of North Marshfield Ave. and walk northbound. This was only a few blocks from the brothers’ Lakeview apartment, which was also the original Uber pick up location to the staged crime scene. Video shows the brothers walking from where they were dropped off toward their home. Two minutes after the brothers exited the taxi, at 2:27 A.M., Defendant Smollett’s manager called the police to report the incident. At approximately 2:42 A.M., Chicago Police arrived at Smollett’s apartment. Chicago Police Officers observed that Smollett had a rope draped around his neck. This was captured on police body worn camera. Seconds later, Smollett asked the Police to shut off the cameras. Smollett then made a police report where he claimed he was the victim of an attack in which the offenders struck him while yelling racial and homophobic slurs. Smollett also reported that the offenders placed a rope around his neck, poured a liquid chemical on him, and told him this is “MAGA Country.” Defendant Smollett also reported for the first time, that three days prior, on January 26, 2019, he received a phone call from an unidentified phone number in which an unidentified male caller stated, “Hey you little F—-” before ending the call. Smollett also told police that the incident happened near a camera, which he stated should have captured the attack. This is the same camera that Defendant Smollett pointed out to the Osundairo brothers in preparation of this staged attack. Smollett also told police that the initial and primary attacker (now known to be Abel Osundairo) was wearing a ski mask which covered his entire face, with the exception of his eyes and the area all around his eyes. Smollett stated to the police that he could see that the area around this person’s eyes was white-skinned. As stated earlier in this proffer, the Osundairo brothers are dark skinned male blacks. During the Good Morning America interview referenced earlier, Smollett stated “And it feels like if I had said it was a Muslim, or a Mexican, or someone black, I feel like the doubters would have supported me much more. A lot more…” These statements by Smollett further misled the police and the public to believe that his attackers were white.
On January 29, 2019 at 7:45 PM, just less than 18 hours following reported attack, Defendant Smollett placed a phone call to Abel and the duration of the call was five seconds. Two minutes later, Abel called back Smollett and the call lasted 1 minute and 34 seconds. The brothers then boarded their flight to Nigeria and left the country. On January 30, 2019 at 10:46 AM, Defendant Smollett called Abel, who was in Istanbul Turkey, and the duration of the call lasted 8 minutes and 48 seconds.
For the next two weeks, the Chicago Police Department investigated this matter as a Hate Crime. Chicago police were able to identify the Osundairo brothers as the alleged attackers through an extensive investigation using Surveillance Videos, Police Pod Videos, in-car taxi camera videos, rideshare records, credit card records, bank records, and a store receipt. On February 13, 2019, the brothers returned from Nigeria, landing at Chicago O’Hare International Airport, and they were detained by US Customs. Members of the Chicago Police Department then placed them into custody. That same evening, the Chicago Police executed a Search Warrant upon the Osundairo brothers’ residence where they recovered evidence which linked Abel to the Empire TV show. Chicago Police already had determined that Ola was affiliated with the show as well. Following their arrest and through consultation with their attorneys, the brothers agreed to cooperate in the investigation. As more evidence, such as text messages, phone records, social media records, bank records, surveillance video and the receipt from the purchase of the rope was obtained by investigators, the investigation shifted from a Hate Crime to a Disorderly Conduct investigation. The Cook County State’s Attorney’s Office approved charges of Disorderly Conduct against Defendant Smollett at 6:10 PM on February 20, 2019. At 5:00 AM this morning (January 21, 2019), Defendant Smollett was placed into custody at Area Central Chicago Police Headquarters."

His two middle names are not part of his official name. "Jussie" is nickname for Justin. He may have added Langston because he played the part of poet Langston Hughes. Bernard was in the film industry for over 60 years making countless commercials, television movies and documentaries. His passion for the arts started at a young age and he pursued this in the army as a photographer and once out of the army he made this his full time career. Bernie lived the most amazing life traveling the world; photographing five presidents;meeting interesting people along the way and fulfilling his dreams. Not too many of us can be so lucky to say they loved their job. Bernie married his high school sweetheart Catherine in November of 1953 and their almost 65 years of marriage was one of his greatest gifts. Bernard was the proudest of his daughter Valerie and his two amazing grandsons Lucas and Matthew. He would talk about them to all his friends with that sparkle in his deep blue eyes. Everyone who met Bernie was touched by his sweetness, kindness, and his remarkable resemblance to “Santa Claus”. Judge Virginia M. Kendall rejected Smollett’s contention that he should not be made to pay $130,000 in police overtime costs, plus $260,000 in damages, because he could not have foreseen how seriously the police would take his hate crime report. The judge also faulted Smollett’s attorneys for its “attempts to muddy the waters with irrelevant arguments.”
Smollett told police on Jan. 29 that he had been assaulted on the street by two men who shouted racial and homophobic slurs, poured bleach on him, and shouted that this was “MAGA country.” The Chicago Police Department engaged in an intensive investigation, ultimately concluding that Smollett had staged the attack.
Kendall held that the intensive investigation was foreseeable, especially given the combustible nature of the allegations.
“The natural, ordinary and reasonable consequence of a police report like this one — a racist, homophobic physical assault in which masked attackers invoked the President of the United States’ official campaign slogan — is an intensive, sprawling investigation like the one that took place,” Kendall wrote. “Smollett contends that police overtime pay is not ‘foreseeable in the normal course of events,’ but this is hardly the normal course of events — most crime victims, for instance, do not have the opportunity to discuss the crime on ‘Good Morning
America.’ The allegations were taken seriously by the Chicago Police Department in significant part due to the high profile of the claimant and the extreme nature of the accusations.”

06/21/2019 A special prosecutor will be appointed to investigate Jussie Smollet's case. If there is enough evidence to charge Smollet, they will charge him.
"A Chicago judge has ordered a special prosecutor to be appointed to review the way prosecutors handled the case and ultimately dismissed it.
The judge said in his order, "If reasonable grounds exist to further prosecute Smollett, in the interest of justice the special prosecutor may take such action." "
05/31/2019 More details from police records. Smollet said to the police that the brothers could not have committed the crime because they are "black as sin." Do we have a light skinned racist? Only times I've ever heard that phrase was when it came from the mouths of old white male racists.
Seems prosecutors told the police to stop investigating the case. Prosecutor has no authority to tell the police that. Generally police investigate then give their evidence to the prosecutor who then decides to prosecute or not. The prosecutor didn't even ask for the police's evidence.

Jussie has moved back to Los Angeles "for security reasons." As long as Jussie doesn't pay people to attack him he should be okay ;-)
One petition to investigate has been dismissed by the attorney who filed it. The other remains and will be heard this Thursday. Jussie Smollett has been requested to be at the hearing.
"Former Illinois Appellate Court Judge Sophia O’Brien also filed a petition asking for a probe. Her petition—which also includes a request for a judge outside of Cook County to make the decision on whether or not a special prosecutor will be appointed—still stands, and a hearing is scheduled for Thursday. O’Brien has not only subpoenaed Foxx and her chief deputy Joseph Magats, but she has also asked that Smollett be present at the hearing."
Empire will have a season six. At the moment Jussie won't be a part of it. Empire did pick up his option. This means he's getting paid something for the possibility to rejoin the show. I'm sure this is because of the investigations and lawsuit against Jussie.
04/23/2019 The brothers just sued Jussie's lawyers for defamation. Here's the tricky thing. If the lawyers made the statements in legal filings, it can never be defamation. If they only made the statements to the press, it can be defamation. The lawyers know Jussie Smollett arranged the attack. They know what they are saying is false. Of course they may lie and state they believed Jussie and thought it was the truth.
In the suit the brothers claim Jussie never told them he was going to file a police report. They thought it was just for social media attention. Oddly the brothers didn't sue Jussie Smollett. Maybe they are hoping Jussie will do the right thing. He won't

04/16/2019 Texts, emails turned over to the Tribune. One text from Kim Foxx to her staff stated "Washed up celeb who lied to cops." The data showed that Foxx office dropped the charges and told Smollett and his lawyer. They in turn told the press that the charges would be dropped at the next hearing which is why the press was there. The police, Mayor did not know the charges would be dropped. They heard it from the many press outlets who were at the hearing.

04/11/2019 Jussie was just sued by the city of Chicago for cost of the investigation.
04/08/2019 Retired Justice Sheila M. O'Brien filed a petition to appoint a special prosecutor to investigate Foxx's handling of the Jussie Smollett case. I'm trying to get a copy of her petition. Justice O'Brien also wrote an op-ed about the case last week which is here.

03/28/2019 This Thursday is the expungement hearing where they will remove the case from Jussie's record. I believe Jussie did the same in Los Angeles when he was caught lying to police, impersonating his brother and driving drunk. I could only find that record in his brother's name and not his name. They should not expunge his record again. Jussie is a repeat offender who lies to police.

It's getting crazier! Chicago is demanding $130,000 to cover costs of the investigation while Smollett's lawyers are demanding an apology from the Mayor and police chief for "for dragging an innocent man’s character through the mud."

Again, Jussie Smollett was not exonerated. The Mayor and Police said he did the crime. The DA just decided to drop the charges because at the end of a trial Jussie probably would have just gotten community service and paid a fine because he was an alleged first time offender. He was arrested and charged in Los Angeles for lying to police and impersonating his brother when he was pulled over for a DUI.
"According to the city law department, the city of Chicago is seeking "immediate payment" of the $130,000 "expended on overtime hours in the investigation of this matter," adding that if the amount is not paid within 7 days the "Department of Law may prosecute" Smollett "for making a false statement to the City" or "pursue any other legal remedy available at law."
03/27/2019 The brothers are now refusing to tell their story. Empire or Smollett must have given them money. It would have to be over $100,000 because that's what their story would be worth. The brothers' attorney then quit.
Cast of Empire is up in arms over the situation. Most don't want Jussie back on the show. I personally feel having Jussie back on the show would hurt the show.

The DA states that Jussie Smollett was not exonerated. Smollett did fabricate the incident. Smollett will have to pay his two friends a lot of money to keep them quiet. Chicago Mayor and police department are very mad that prosecutors dropped the case against Smollett.

After having the charges dropped Jussie Smollett is still lying about what happened, didn't happened. He should have kept quiet. This is going to backfire for Smollett.
This is a wild one. Below is Jussie Smollett's statement. After that we'll talk about reality. Jussie is either not very bright or he has narcissistic personality disorder. How in the world did he think he would be able to get away with this stunt?
“I would not be my mothers son if I was capable of doing what I was accused of,” Smollett said after prosecutors dropped all the charges. “I’d like nothing more than to just get back to work and move on with my life, but make no mistakes I will always continue to fight for the justice, equality, and betterment of marginalized people everywhere.”
"Cook County prosecutors agreed to drop the charges against Smollett at an unscheduled hearing in the case Tuesday morning. Smollett will forfeit the $10,000 bail he posted after his arrest."
The prosecutors agreed to drop the charges if Jussie Smollett forfeited the $10,000 bail. Judge granted a motion to seal the case. If Jussie Smollett were actually cleared, he wouldn't forfeit the $10,000. The $10,000 is, I believe, to pay for the cost of the investigation. I believe the DA agreed to drop the charges because of the leaks in the investigation. Smollett could have argued that the leaks harmed him. One leak was that Smollett paid $3,500 to his two friends to stage the event. The check actually stated it was for fitness consulting. I believe in reality it probably was for them to stage the event.

“After reviewing all of the facts and circumstances of the case, including Mr. Smollett’s volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case,” the Cook County State’s Attorney’s office stated in an email."
Police Supt Eddie Johnson is upset about the ruling. He wasn't even notified. I'm pretty sure this is the result of Smollett's attorney threatening to sue the City over the leak and press conference. I don't think Smollett is innocent. If he were, the two brothers would be arrested. I have no respect for Jussie Smollett at all.
What will be very interesting is if the brothers sell their story. I believe the brothers. Maybe Jussie will strike a deal, settlement with the brothers. I don't believe Jussie Smollett because he has a history of lying to police, see below. I don't believe Smollett is innocent.
03/08/19 It gets even more disgusting! Smollett's attorney Mark Geragos just stated that the police have the two people who committed this crime. Smollett is willing to state that his two black buddies committed the crime against him!! Justin "Jussie" Smollett is truly a disgusting person. He keeps digging his grave. He will not recover from this. He should have confessed earlier. Police already know that Smollett previously lied to police and tried to blame his own brother for his own crime of DUI.
Smollett indicted for 16 felony counts of filing a false police report of a hate crime. They are charging him for 16 counts because he made 16 separate lies. That's 1-3 years in prison and a $25,000 fine for each lie. He does have a prior for lying to police. He's now facing a much longer prison time. Previously it was just one count but they decided to add the lies together. He did waste a lot of police resources but I think the potential of 48 years would be way too excessive. 02/21/2019 I was told Jussie used his brother's name for a DUI in Los Angeles. I searched the court records. You can only find it by searching Jake Smollett. Jussie was charged with DUI, driving without a license and lying to police. Here is the case.

Jussie Smollett removed from final episodes of Empire. Cast wanted him gone. He sure effed up his career and reputation. Statement from Empire.
“The events of the past few weeks have been incredibly emotional for all of us… Jussie has been an important member of our Empire family for the past five years and we care about him deeply… While these allegations are very disturbing, we are placing our trust in the legal system as the process plays out. We are also aware of the effects of this process on the cast and crew members who work on our show and to avoid further disruption on set, we have decided to remove the role of ‘Jamal’ from the final two episodes of the season.”
Jussie went to the Empire set and stated as follows.
“I’m sorry I’ve put you all through this and not answered any calls. I wanted to say I’m sorry and, you know me, I would never do this to any of you, you are my family. I swear to God, I did not do this.”
As the details come out it just gets worse and worse. Jussie kept the noose around his neck for 42 minutes after the assault. Common reaction would be to instantly remove it.
In dumb criminal news Jussie paid the brothers with a check! Jussie bought Extacy from one of the brothers via text! I bet he paid with another check. The brothers saved the receipt for the shit they bought to stage the crime!
Jussie Smollett was booked this morning at 5:00 a.m. in Chicago. He has a bail hearing later today. His motive for this stunt was to get a bigger paycheck from Empire. Now he'll be getting a lot less. Really dumb move for so many reasons. Police stated he made and sent the hate letter to himself.

Illinois Statutes Chapter 720. Criminal Offenses § 5/26-1. Disorderly conduct
§ 26-1. Disorderly conduct.
(a) A person commits disorderly conduct when he or she knowingly:
(4) Transmits or causes to be transmitted in any manner to any peace officer, public officer or public employee a report to the effect that an offense will be committed, is being committed, or has been committed, knowing at the time of the transmission that there is no reasonable ground for believing that the offense will be committed, is being committed, or has been committed;
Violation is Class 4 felony. Sentence 1-3 years in prison and fines up to $25,000.
I personally feel he should pay for all costs of the investigation no matter what the cost.
Here is the full, unabridged account of the police investigation into Jussie Smollett’s involvement in staging his own attack from the court documents:
BOND PROFFER
Defendant: Jussie Smollett (DOB 6/21/82) – 36 years old Charge: Disorderly Conduct-False Report (Class 4 Felony)
The Defendant Jussie Smollet is an Actor and Singer-Songwriter, who currently appears as a character on the Fox television show “Empire.” Defendant Smollett currently resides in an Apartment in Chicago’s Streeterville neighborhood.
The People expect the evidence to show that:
On Tuesday, January 22, 2019. Defendant Smollett received a written letter at the Cinespacc Chicago Film Studios, which is a facility on the Southwest Side of Chicago where the Empire Television Show is filmed. This letter contained written threats directed toward Defendant Smollett, and contained a then unknown white powdery substance. The letter also contained cut out letters pieced together which stated “Smollett Jessie you will die black f–“, and the word “MAGA” was hand written on the envelope where the return address is typically located. This powdery substance has since been determined to be crushed ibuprofen tablets. The letter also contained a drawing of a stick figure, which appears to have a rope around the neck and a gun pointed at it. Law enforcement authorities were contacted, and the letter was turned over to the Federal Bureau of Investigation, which is currently conducting forensic analysis of the letter.
In January of 2019, and at all times relevant hereto, Defendant Smollett was close friends with an individual by the name of Abimbola “Abel” Osundairo, who is 25 years old. Smollett and Abel initiated their friendship in the fall of 2017. During the course of this friendship, Defendant Smollett and Abel socialized together, exercised together, as well as worked together on the Fox television series Empire. Within that working relationship, Abel was a stand-in for a character named “Kai”, who is a love interest of Defendant Smollet’s character on the Empire TV Show. Additionally, text messages between Defendant Smollett and Abel revealed that Abel was a source of designer drugs for Defendant Smollett. Specifically, since the spring of 2018, on several occasions, Defendant Smollett requested Abel to provide him with “Molly”, which is a street name for the narcotic Ecstasy. Text messages generated by Defendant Smollett to Abel, specifically starting on the morning of January 25, 2019, reveal Defendant Smollett asking Abel when he would be leaving on his upcoming trip to Nigeria. This trip was scheduled to take place on the evening of January 29, 2019, and it had been planned by Abel and his brother Olabinjo “Ola” Osundairo (27 years old) two months prior.
After Abel confirmed the date and time of his trip, Defendant Smollett texted Abel stating “Might need your help on the low. You around to meet up and talk face to face?” The two than made arrangements to meet at the Cinespace Studios that afternoon, where Defendant Swollen subsequently drove Abel home to Abel’s apartment in the Lakeview neighborhood. During the ride, Defendant Smollett indicated to Abel his displeasure with the Empire Studio’s handling of the racist and homophobic letter he received three days prior. Defendant Smollett then stated that he wanted to stage an attack where Abel would appear to batter him. Defendant Smollett also suggested that Abel’s older brother Ola assist him with the attack. Defendant Smollett had met Ola on several previous occasions through Abel. Additionally, Ola had also appeared as an extra of the Empire TV show. Abel and Ola are both dark skinned, black males, born in the United States. with Nigerian decent.
When Defendant Smollett and Abel reached Abel’s apartment at approximately 5:00 PM on January 25, 2019, Ola, who was then living with Abel, was summoned into Defendant Smollett’s vehicle. Once inside, Smollett asked Ola if he could trust him. When Ola said he could, Smollett detailed his plans of the attack to the brothers. Defendant Smollett stated that he wanted them to appear to attack him on the evening of January 28, 2019 near his apartment building in Streeterville. Defendant Smollett also stated that he wanted the brothers to catch his attention by calling him an “Empire F Empire N .” Defendant Smollett further detailed that he wanted Abel to attack him, but not hurt him too badly and give him a chance to appear to fight back. Defendant Smollett also included that he wanted Ola to place a rope around his neck, pour gasoline on him and yell “This is MAGA country.” Prior to the brothers getting out of Smollett’s car, Smollett provided Abel with a $100 bill to purchase the rope, gasoline, ski masks, gloves and red baseball caps which resemble the ones that say “Make America Great Again.” The ride from Cinescape Studios to the Osundairo brothers’ home and the meeting between Smollett and the brothers is corroborated by CPD POD videos and cellular phone tower data of Smollett’s phone number.
On the late morning of Sunday January 27, 2019, Swollen drove his vehicle back to the Lakeview neighborhood to pick up the brothers and show them the scene where he wanted the staged attack to take place. Smollett then drove the brothers to the corner of New Street and North Water Street in Chicago where the staged attack was to take place. This was just outside Smollett’s apartment building. Further details were provided by Smollett which included that the staged attack was to take place near the stairs on the southwest comer of New and North Water Streets at 10:00PM the following night. Smollett also instructed the brothers not to bring their cell phones with them. Smollett directed the brothers’ attention toward a surveillance camera on the corner, which he believed would capture the incident. There was a change in the plan that bleach was going to be used rather than gasoline during the simulated attack. Smollett then drove the brothers home and provided them with a $3500 personal check made payable to Abel, which was backdated to January 23, 2019. On the morning of January 28, 2019, the date of the planned incident, the brothers purchased the clothing items at a local beauty supply store and the rope at a nearby hardware store, using the $100 bill that Smollett had given them. These purchases were corroborated by surveillance video and a receipt. Abel also deposited Smollett’s check that same day in his own bank account. Later that evening, the plan had changed and the time of the attack had to be pushed back because Smollett’s flight into O’Hare Airport from New York had been delayed by four hours. Smollett’s plane eventually landed at O’Hare at 12:30 AM on January 29, 2019. At 12:49 AM, there was a phone call between Smollett and Abel which lasted three minutes. During this call, Smollett told Abel the attack would take place at exactly 2:00 AM at the preset location. Minutes later Ola ordered an Uber ride share to his home to leave for the crime scene. Cell phone records and Uber records confirm this call and the Uber ride.
The brothers then took the Uber to the 1400 block of North Wells where they exited the Uber and flagged down a taxi which took them to within three blocks of the arranged scene at approximately 1:22 AM. The taxi’s in-car video captures the brothers flagging the cab and riding in the back seat.
From approximately 1:22A.M. until approximately 2:03A.M., video evidence showed the brothers on foot in an area bordered by Lake Shore Drive on the east, Columbus Drive on the west, Illinois Street to the north, and the Chicago River to the south. Video evidence also showed that Smollett returned back to his apartment from the airport at approximately 1:30 AM. At 1:45 AM, Smollett left his building to walk to a nearby Subway restaurant at Illinois Street and McClurg Court At 2:00 AM, the brothers were at the intersection of New St. and North Water Street: however, Defendant Smollett did not arrive exactly at the preset time. The brothers then proceeded a quarter block north and waited near a bench until Smollett arrived, which was four minutes later. Surveillance cameras captured the brothers waiting at this location just prior to the staged attack. During Smollett’s interview on ABC’s Good Morning America which aired on February 14, 2019, he identified the people shown in a still of this surveillance video as his attackers. Also, during this interview, Smollett indicated that he was positive that these were his attackers. The two men in this video are in fact that Osundairo brothers.
It was at this time, that the brothers staged the attack of Defendant Smollett just how Smollett had instructed them. While the staged attack was occurring, a witness, who is an employee of NBC News Chicago, had just parked and exited her vehicle just around the corner from the location of the staged attack. This witness indicated that she heard nothing at the time the staged attack was occurring, despite the fact that Defendant Smollett told CPD detectives that his attackers were “yelling” racial and homophobic slurs at him, and he in turn was “yelling” back at them. The staged attack lasted 45 seconds, and it was just outside the view of the desired nearby camera that Smollett had pointed out to the brothers approximately 15 hours earlier.
Approximately one minute later, video evidence showed the brothers run from the location, southbound toward the Chicago River and westbound toward Columbus Drive. Video evidence also captured the brothers entering a taxi at the Hyatt Regency Hotel across the river at 02:10 A.M.
Video evidence then showed that at 2:25 AM, the brothers exit the taxi on the 3600 block of North Marshfield Ave. and walk northbound. This was only a few blocks from the brothers’ Lakeview apartment, which was also the original Uber pick up location to the staged crime scene. Video shows the brothers walking from where they were dropped off toward their home. Two minutes after the brothers exited the taxi, at 2:27 A.M., Defendant Smollett’s manager called the police to report the incident. At approximately 2:42 A.M., Chicago Police arrived at Smollett’s apartment. Chicago Police Officers observed that Smollett had a rope draped around his neck. This was captured on police body worn camera. Seconds later, Smollett asked the Police to shut off the cameras. Smollett then made a police report where he claimed he was the victim of an attack in which the offenders struck him while yelling racial and homophobic slurs. Smollett also reported that the offenders placed a rope around his neck, poured a liquid chemical on him, and told him this is “MAGA Country.” Defendant Smollett also reported for the first time, that three days prior, on January 26, 2019, he received a phone call from an unidentified phone number in which an unidentified male caller stated, “Hey you little F—-” before ending the call. Smollett also told police that the incident happened near a camera, which he stated should have captured the attack. This is the same camera that Defendant Smollett pointed out to the Osundairo brothers in preparation of this staged attack. Smollett also told police that the initial and primary attacker (now known to be Abel Osundairo) was wearing a ski mask which covered his entire face, with the exception of his eyes and the area all around his eyes. Smollett stated to the police that he could see that the area around this person’s eyes was white-skinned. As stated earlier in this proffer, the Osundairo brothers are dark skinned male blacks. During the Good Morning America interview referenced earlier, Smollett stated “And it feels like if I had said it was a Muslim, or a Mexican, or someone black, I feel like the doubters would have supported me much more. A lot more…” These statements by Smollett further misled the police and the public to believe that his attackers were white.
On January 29, 2019 at 7:45 PM, just less than 18 hours following reported attack, Defendant Smollett placed a phone call to Abel and the duration of the call was five seconds. Two minutes later, Abel called back Smollett and the call lasted 1 minute and 34 seconds. The brothers then boarded their flight to Nigeria and left the country. On January 30, 2019 at 10:46 AM, Defendant Smollett called Abel, who was in Istanbul Turkey, and the duration of the call lasted 8 minutes and 48 seconds.
For the next two weeks, the Chicago Police Department investigated this matter as a Hate Crime. Chicago police were able to identify the Osundairo brothers as the alleged attackers through an extensive investigation using Surveillance Videos, Police Pod Videos, in-car taxi camera videos, rideshare records, credit card records, bank records, and a store receipt. On February 13, 2019, the brothers returned from Nigeria, landing at Chicago O’Hare International Airport, and they were detained by US Customs. Members of the Chicago Police Department then placed them into custody. That same evening, the Chicago Police executed a Search Warrant upon the Osundairo brothers’ residence where they recovered evidence which linked Abel to the Empire TV show. Chicago Police already had determined that Ola was affiliated with the show as well. Following their arrest and through consultation with their attorneys, the brothers agreed to cooperate in the investigation. As more evidence, such as text messages, phone records, social media records, bank records, surveillance video and the receipt from the purchase of the rope was obtained by investigators, the investigation shifted from a Hate Crime to a Disorderly Conduct investigation. The Cook County State’s Attorney’s Office approved charges of Disorderly Conduct against Defendant Smollett at 6:10 PM on February 20, 2019. At 5:00 AM this morning (January 21, 2019), Defendant Smollett was placed into custody at Area Central Chicago Police Headquarters."

ORIGINAL: I'm writing this article because I just realized Jussie seems to have made up a biography that differs from reality. He said his mother was born in New Orleans when she was born in Texas. He said his father was a Russian, Polish Jew when he was born in the US as was his grandfather.
The last name Smollett means "small head" in English and Scotland. Original family is from Iasi, Romania. Original last name is Smilowitz which they changed in 1940. Second great grandfather of Jussie was Jacob Smilowitz Smollett was a bricklayer. His wife Rebecca Moscowitz was his wife.
Jussie Smollett aka Jussie Langston Mikha Smollett was born Justin Smollett in Santa Rosa, Sonoma County, California on June 21, 1982 at the Community Hospital. He weighed 8 lbs and 7 ounces. His two middle names are not part of his official name. "Jussie" is nickname for Justin. He may have added Langston because he played the part of poet Langston Hughes. I don't know where the Mikha comes in. His birth certificate says "Justin Smollett."
His father was Joel Smollett 1956 - 2015. His mother is Janet Faye Harris born 1952 in Texas. They were married 1975 in San Francisco, California. Janet was a checker at a sweater warehouse and Joel was a warehouseman and cable splicer for the phone company. Joel actually wrote a letter to the editor in the LA Times about the difference between freedom of speech and hate speech. His siblings are Joel "Jojo," Jazz, Jurnee, Jake and Jocqui. Jussie's great uncle Bernard Martin Hirschenson was also in the film industry for over 60 years.

Born in Manhattan, NewYork on March 21, 1931 in a taxi cab to parents Isadore and Gertrude Hirschenson he was raised in the Bronx. He has lived in Wanaque for the past 12 years, before that he lived in Ho-H0-Kus for 40 years. Bernard was in the film industry for over 60 years making countless commercials, television movies and documentaries. His passion for the arts started at a young age and he pursued this in the army as a photographer and once out of the army he made this his full time career. Bernie lived the most amazing life traveling the world; photographing five presidents;meeting interesting people along the way and fulfilling his dreams. Not too many of us can be so lucky to say they loved their job. Bernie married his high school sweetheart Catherine in November of 1953 and their almost 65 years of marriage was one of his greatest gifts. Bernard was the proudest of his daughter Valerie and his two amazing grandsons Lucas and Matthew. He would talk about them to all his friends with that sparkle in his deep blue eyes. Everyone who met Bernie was touched by his sweetness, kindness, and his remarkable resemblance to “Santa Claus”. Bernie would not cut his beautiful white hair for a few months leading up to that special day in December. The original family name was Smilowitz which they changed to Smollett in 1940. That was the Americanized version of their name. David Smollett's parents were Jacob A Smilowitz Smollett 1865-1951 and Rebecca 1869-1951.
